We are especially excited about this result, as our client and her children finally have a safe haven in Canada. 💛🌻

Our client came to us after having escaped an extremely abusive marriage relationship. She and her children suffered for years as her ex-husband physically, psychologically and financially abused and neglected the family. When the family finally arrived in Canada in the promise that the husband would sponsor them, they were abandoned in the dead of Canadian winter, with nowhere to go.

We were able to connect the family with an agency that provided housing and support services for families fleeing violence. However, without the appropriate immigration documents, the mother could not support the family and the children could not attend school.

We requested special permission from IRCC to allow the family to remain in Canada for one year so that they could get back up on their feet. To our pleasant surprise, IRCC approved the family to work and study in Canada for an additional second year.

At Alemyehu Law, these are the outcomes that fuel us to continue advocating for migrants and their families. We are passionate about being present for people in their darkest hour, with the hope that our support will help them find a way forward.

We are celebrating with our client who was granted permanent residence and met her in-laws for the first time! 🎉

Our client and her husband were married during the height of the COVID-19 pandemic. Due to travel restrictions, neither of their families were able to attend. Thanks to technology, our client formed strong bonds with her in-laws but was refused a visa multiple times to visit them. During the processing of her permanent residence application, the couple had to leave the country where they were residing because it was no longer safe to live there due to instability in the region. Despite all these obstacles, our client was able to secure permanent residence. After four years, our client finally met with her beloved family for the first time. Even more exciting was that we were able to secure this result quicker than the average time!

Our sincerest condolences to the client’s grandparent-in-law, who tragically passed away before we were able to secure this result. 💐 It is a reality for many that delays in immigration processing causes heartbreak like this.

The Government of Canada has made more sweeping changes to its temporary residence program, including further reduction of study permits issued; limiting eligibility for work permits of students, and spouses of students and workers; and measures to process asylum claims and detect fraud by non-genuine.

These measures will significantly impact foreign nationals both outside and inside Canada.

It is not clear what the impact of these measures may be on those who come to Canada with the dual intent of temporary and permanent residence as per section 22(2) of the Immigration and Refugee Protection Act.

Marc Miller has stated, “The reality is that not everyone who wants to come to Canada will be able to—just like not everyone who wants to stay in Canada will be able to. We are taking action to strengthen our temporary residence programs and roll out a more comprehensive immigration plan to meet the demands of today’s changing landscape. Our immigration system must preserve its integrity, and be well managed and sustainable. And as we look forward, we will do everything it takes to achieve that goal and set newcomers up for success.”

“Immigration, Refugees and Citizenship Canada (IRCC) has ended a temporary public policy that allowed visitors to apply for a work permit from within Canada, effective immediately.

IRCC introduced the policy in August 2020 to help visitors who were unable to leave the country due to COVID-19 pandemic–related travel restrictions. Under the policy, visitors in Canada could apply for a work permit without having to leave the country. In addition, foreign nationals who had held a work permit in the previous 12 months but who changed their status in Canada to “visitor” could apply to work legally in Canada while waiting for a decision on their new work permit application.

While the temporary policy was set to expire on February 28, 2025, IRCC is ending the policy as part of our overall efforts to recalibrate the number of temporary residents in Canada and preserve the integrity of the immigration system. IRCC is also aware that some bad actors were using the policy to mislead foreign nationals into working in Canada without authorization.”

We are celebrating with our clients whose grandparent was approved for a visitor record extension! 🎉

Our clients’ grandparent had been visiting them in Canada after a long separation due to life circumstances and COVID. They were just not ready to say goodbye yet as their grandparent was going to celebrate a milestone birthday, and one granddaughter was to get married. We were able to advocate for the grandparent to stay an additional 8 months - but he was granted an entire 1 year instead! This was an exciting and satisfying win for all of us, but especially for this close-knit family.

We are very happy for our client who received this positive result 🎉

This client was on the final stages of getting Canadian citizenship. IRCC began an investigation against our client for misrepresenting on a previous application. However, IRCC wrote a letter that did not explain why this investigation started and what information they were relying on.

After many back and forth emails and letters and an Access to Information Request, we still did not understand why this investigation was being started. We pushed IRCC for more information and they decided to drop the investigation.

Our client is very fortunate to have gotten this result. He was under a lot of stress and was saddened that this came up during a time when he was preparing to celebrate the conclusion of his immigration journey.

But we can't help but think of the many people who don't have someone to advocate for them, to ensure that the government is dealing with them fairly and with due process. We are reminded that the work we do for our clients can be significant.

Let’s talk citizenship 🇨🇦 In Canada, citizenship is granted to those who meet the following requirements:

🍁 Be a permanent resident
🍁 Lived in Canada for 3 out of the last 5 years
🍁 Have filed your taxes if you need to
🍁 Prove your language skills
🍁 Pass a test on Canadian history and facts
🍁 Take an oath of citizenship

It seems straightforward, doesn’t it? The truth is that it is much more complicated than this.

🍁 Your entire immigration history may be brought under scrutiny.
🍁 Past mistakes you’ve made may slow down or even stop you from becoming a Canadian citizen.
🍁 Your relationship with family members may impact your ability to become a citizen.

In 2000, my family and I became Canadian citizens. My parents bore the brunt of ensuring we met all requirements to receive our grants. Looking at my parents that day, I knew that what was happening that day was significant. As my parents tell the story, when it was our turn to take a photo with a citizenship judge, I ran and wrapped my arms around her legs, saying, “Thank you, thank you, thank you!”

But the truth was that day, Canada gained four unique persons who were ready to bet their hopes and dreams in this country. Everyday, the mosaic of Canada becomes more colourful, and the responsibility for Canada becomes greater, to ensure a country that respects and honours all persons who call this place their home.

Canadian citizenship is not a right, and I wouldn’t describe it as a privilege either, though the law posits it as such. Canadian citizenship is meaningful in that it is a call to be better stewards and neighbours. It stirs us to appreciate one another and care for the land we are on. It calls us to acknowledge our history and reimagine our future.
