We had an incredibly busy week at Lumina Lawyers LLP, and finishing off our Friday strong with a successful outcome in a Parent Sponsorship Appeal before the Immigration Appeal Division. After hearing from our client, the Appellant, the Member set side the Officer’s refusal, directing the application will now continue for processing.
Family reunification is a cornerstone of Canada’s immigration system, and we are proud to support clients seeking to bring parents to Canada under humanitarian and compassionate considerations.

Last week, our lawyers Amanpreet Grewal - Canadian Immigration Law and Family Law Lawyer and Prabdeep had the pleasure of presenting on Wills & Estates to the South Calgary Seniors Cultural Society (https://www.scscsociety.com).

This diverse group includes business owners, executives, family caregivers, and community leaders who meet regularly to uphold the Society’s values—one of which is lifelong learning. We tailored our presentation to address the wide range of estate planning needs among their members and appreciated the thoughtful questions and engaging discussion that followed.

We have been so busy attending to our clients and the various court proceedings scheduled for our Family Law clients and our Immigration Law clients that we did not have the time to share any of our recent success stories. Here is a success story from last week:

After hearing of the positive experience her friend had with Lumina Lawyers LLP with his cousin’s Visitor Visa Application (cousin abroad had six prior refusals), a brilliant young woman contacted us to request us to assist her brother with his Canadian Visitor Visa Application.

Previously, with the assistance of other immigration professionals, her brother had submitted not one, not two, but three temporary resident applications. The first two applications were for a study visa and the third application was for a visitor visa. All three had been refused for different reasons.

When discussing this matter with our client and his sister, we were very honest and transparent, ensuring accurate expectations were set. We informed them from the outset of what this legal journey would look like. Our client was informed from the very outset that the chances of his Visitor Visa Application being approved at the outset were low (due to the previous refusals and IRCC’s use of AI), and that we would most likely have to continue in Federal Court. Our client trusted our advice, as did his sister, and embarked on this legal journey with us.

We prepared and submitted a detailed and fulsome Visitor Visa Application, which was, as expected, refused. As planned, we commenced the Federal Court process.

After filing our initial Application with the Federal Court, we made detailed submissions as to why our Application should be granted. Shortly thereafter, Minister’s Counsel notified us that they consented to our Federal Court Application and the Visitor Visa Application would be redetermined by a different Visa Officer. This was great news for our client, who did not have to go through the entire Federal Court process, saving him not only time, but also legal fees.

The Visitor Visa Application was returned to a different Visa Officer, who requested us to submit updated documents to support the Visitor Visa Application, which we submitted on Wednesday, October 16, 2024. On Thursday, October 24, 2024, IRCC notified us that the Visitor Visa Application had been approved!

We immediately informed our client and his sister of the approval, who were overjoyed. A brother will now be travelling to Calgary, Alberta in the near future to meet his sister!

The entire team at Lumina Lawyers LLP thanks our client and his sister for their continued trust and faith in us. We are incredibly happy for our clients success and look forward to meeting with him once he is in Canada!
