This complex case dealt with an international student in a 4-year program with an extended authorized leave exceeding 150 days.

During her leave of absence, the student entered and exited Canada multiple times until finally returning to Canada and completing her program in full.

Although she completed her program, leave beyond 150 days typically raises non-compliance concerns under IRCC requirements.

To prevent the common mistake of forgetting to upload a language test, IRCC has now included a Proof of Language Proficiency field under the Optional Documents section.

If you are applying for your PGWP or already hold one, your spouse may be eligible to apply for an SOWP.

An important requirement is your job/job offer. The principal applicant (PA - i.e: the PGWP holder/applicant) generally must be working, or will be working, in one of the following:

✅ Any NOC TEER 0 occupation
✅ Any NOC TEER 1 occupation
✅ Select NOC TEER 2 occupations listed by IRCC
✅ Select NOC TEER 3 occupations listed by IRCC

Your job title alone does NOT determine your NOC code. Immigration officers assess your occupation based on the duties you actually performed. When selecting a NOC, review the lead statement and main duties to ensure they accurately reflect the nature of your work.

🚨 Another Complex PGWP Approval! PART-TIME SEMESTER OUTSIDE FINAL TERM🚨

Most students are told:

❌ “One part-time semester = automatic refusal.”
And yes, a part-time semester outside the final term NORMALLY absolutely create serious PGWP eligibility concerns.

In this case:

⚠️ The student had a part-time semester outside the final academic term
⚠️ This normally puts PGWP eligibility at risk
⚠️ Many people would assume the case was hopeless
But immigration rules are often FAR more nuanced than people realize.

We made a case-specific legal argument based on IRCC’s own wording and policy framework to demonstrate that the student still remained eligible despite the isolated part-time semester.

This was NOT:

❌ hiding the issue
❌ hoping the officer wouldn’t notice
❌ “getting lucky”

The application directly acknowledged the concern and addressed it proactively using the specific facts of the case and the technical wording of IRCC’s own criteria.
