𝗬𝗼𝘂𝗿 𝘁𝗿𝗮𝗻𝘀𝗰𝗿𝗶𝗽𝘁 𝗰𝗮𝗻 𝗿𝗲𝘃𝗲𝗮𝗹 𝗣𝗚𝗪𝗣 𝗿𝗲𝗱 𝗳𝗹𝗮𝗴𝘀 𝗯𝗲𝗳𝗼𝗿𝗲 𝗜𝗥𝗖𝗖 𝗱𝗼𝗲𝘀.

Before you submit your PGWP application, review your academic history carefully for issues such as:

• part-time studies outside the final semester
• gaps in studies
• withdrawals, failed or low grades
• co-op irregularities
• program or school changes
• uncertainty about your completion date

These issues do 𝗻𝗼𝘁 all mean the same thing.

For example:

• 𝘄𝗶𝘁𝗵𝗱𝗿𝗮𝘄𝗮𝗹𝘀 may affect whether you were enrolled full-time
• 𝗳𝗮𝗶𝗹𝗲𝗱 𝗼𝗿 𝗹𝗼𝘄 𝗴𝗿𝗮𝗱𝗲𝘀 are not always the issue on their own, but a pattern may raise concerns about whether you actively pursued studies
• 𝗰𝗼-𝗼𝗽 𝗽𝗿𝗼𝗯𝗹𝗲𝗺𝘀 can sometimes create more serious compliance concerns
• 𝗺𝘂𝗹𝘁𝗶𝗽𝗹𝗲 𝗽𝗿𝗼𝗴𝗿𝗮𝗺 𝗰𝗵𝗮𝗻𝗴𝗲𝘀 may raise questions about whether you were actively pursuing studies
• 𝘁𝗵𝗲 𝗰𝗼𝗺𝗽𝗹𝗲𝘁𝗶𝗼𝗻 𝗱𝗮𝘁𝗲 is generally the first date you were notified that you met the requirements to graduate, which can affect both PGWP timing and work authorization

A red flag does 𝗻𝗼𝘁 𝗮𝘂𝘁𝗼𝗺𝗮𝘁𝗶𝗰𝗮𝗹𝗹𝘆 𝗺𝗲𝗮𝗻 𝗿𝗲𝗳𝘂𝘀𝗮𝗹.

But it also does 𝗻𝗼𝘁 𝗮𝘂𝘁𝗼𝗺𝗮𝘁𝗶𝗰𝗮𝗹𝗹𝘆 𝗺𝗲𝗮𝗻 𝘁𝗵𝗲 𝗽𝗿𝗼𝗯𝗹𝗲𝗺 𝗰𝗮𝗻 𝗯𝗲 𝘀𝗼𝗹𝘃𝗲𝗱 𝗷𝘂𝘀𝘁 𝗯𝘆 𝘂𝗽𝗹𝗼𝗮𝗱𝗶𝗻𝗴 𝗺𝗼𝗿𝗲 𝗱𝗼𝗰𝘂𝗺𝗲𝗻𝘁𝘀.

Sometimes there is a legal argument that the applicant remains eligible.
Sometimes the issue is much more serious.
Sometimes the application depends on how the facts, records and applicable rules interact.

The key is to understand what the issue actually means 𝗯𝗲𝗳𝗼𝗿𝗲 you apply.

𝗔 𝗰𝗹𝗶𝗲𝗻𝘁 𝗳𝗮𝗶𝗹𝗲𝗱 𝗮 𝗿𝗲𝗾𝘂𝗶𝗿𝗲𝗱 𝗰𝗼𝘂𝗿𝘀𝗲 𝗮𝗻𝗱 𝗯𝗲𝗰𝗮𝗺𝗲 𝗽𝗮𝗿𝘁-𝘁𝗶𝗺𝗲 𝗼𝘂𝘁𝘀𝗶𝗱𝗲 𝘁𝗵𝗲 𝗳𝗶𝗻𝗮𝗹 𝘀𝗲𝗺𝗲𝘀𝘁𝗲𝗿.

𝗧𝗵𝗲 𝗣𝗚𝗪𝗣 𝘄𝗮𝘀 𝗮𝗽𝗽𝗿𝗼𝘃𝗲𝗱. ✅

This was a high-risk application, and the outcome should 𝗻𝗼𝘁 be interpreted to mean that someone in the same situation will receive the same result.

Certain details of this case have been generalized to protect client confidentiality.

The client's academic progression was affected after they did not successfully complete a required course.

As a result:

⚠️ Their academic sequence changed
⚠️ Their records showed part-time studies outside the final semester
⚠️ Their program took longer to complete than originally expected

That created a significant PGWP eligibility concern.

IRCC generally requires PGWP applicants to have maintained full-time student status during each academic semester in Canada, subject to the specific situations recognized under the applicable rules.

𝗣𝗮𝗿𝘁-𝘁𝗶𝗺𝗲 𝘀𝘁𝘂𝗱𝗶𝗲𝘀 𝗼𝘂𝘁𝘀𝗶𝗱𝗲 𝘁𝗵𝗲 𝗳𝗶𝗻𝗮𝗹 𝘀𝗲𝗺𝗲𝘀𝘁𝗲𝗿 𝗰𝗮𝗻 𝗿𝗲𝘀𝘂𝗹𝘁 𝗶𝗻 𝗮 𝗣𝗚𝗪𝗣 𝗿𝗲𝗳𝘂𝘀𝗮𝗹.

We therefore did not ignore the issue or assume that IRCC would overlook it.

The application included supporting school documentation explaining the client's academic progression, together with detailed submissions addressing the part-time period, the surrounding circumstances and the relevant immigration rules and jurisprudence.

𝗧𝗵𝗲 𝗣𝗚𝗪𝗣 𝘄𝗮𝘀 𝗮𝗽𝗽𝗿𝗼𝘃𝗲𝗱. ✅

Importantly, IRCC does not provide reasons when it approves a PGWP application.

We therefore 𝗰𝗮𝗻𝗻𝗼𝘁 𝗸𝗻𝗼𝘄 𝘄𝗵𝘆 𝘁𝗵𝗲 𝗼𝗳𝗳𝗶𝗰𝗲𝗿 𝗮𝗽𝗽𝗿𝗼𝘃𝗲𝗱 𝘁𝗵𝗶𝘀 𝗽𝗮𝗿𝘁𝗶𝗰𝘂𝗹𝗮𝗿 𝗮𝗽𝗽𝗹𝗶𝗰𝗮𝘁𝗶𝗼𝗻.

We cannot say that:

❌ IRCC accepted a particular argument
❌ IRCC treated the circumstances as an exception
❌ The same facts would produce the same result for another applicant
❌ This approval creates a precedent

The takeaway from this case is much narrower:

𝗜𝗳 𝘆𝗼𝘂𝗿 𝗮𝗰𝗮𝗱𝗲𝗺𝗶𝗰 𝗵𝗶𝘀𝘁𝗼𝗿𝘆 𝗰𝗼𝗻𝘁𝗮𝗶𝗻𝘀 𝗮 𝗽𝗼𝘁𝗲𝗻𝘁𝗶𝗮𝗹 𝗣𝗚𝗪𝗣 𝗲𝗹𝗶𝗴𝗶𝗯𝗶𝗹𝗶𝘁𝘆 𝗽𝗿𝗼𝗯𝗹𝗲𝗺, 𝗶𝗱𝗲𝗻𝘁𝗶𝗳𝘆 𝗶𝘁 𝗯𝗲𝗳𝗼𝗿𝗲 𝘆𝗼𝘂 𝗮𝗽𝗽𝗹𝘆 𝗮𝗻𝗱 𝘂𝗻𝗱𝗲𝗿𝘀𝘁𝗮𝗻𝗱 𝘁𝗵𝗲 𝗿𝗶𝘀𝗸.

A part-time semester, leave from studies, failed or withdrawn course, unusual break, or other academic irregularity should not simply be ignored because another applicant with a superficially similar situation received an approval.

Every case depends on its own facts, documents and applicable rules.

Details determine the outcome.

At first glance, this looked like a simple PGWP application. However, we found important issues in the school documents when reviewing the client's case, including an incorrect credential name (Bachelor Diploma instead of Bachelor Degree) and the use of the client's nickname instead of their legal name.

Small errors like this can create unnecessary problems with IRCC.

- Bachelor Diploma vs Degree: Diploma level programs have different eligibility criteria such as language and field of study. This creates uncertainty around how the application will be assessed or lead to potential officer error.
- Nickname instead of legal name: Wrong name issued can create questions around authenticity of documents and if it has been issued to the right person.

We caught these issues right away and had the school correct the inconsistencies in the documents, leading to a smooth application approval.

A good reminder: even “simple” applications deserve a deep-dive.

A PGWP application was refused because the applicant had one part-time semester during his studies.

At first glance, that may seem like a straightforward eligibility issue, but there was an important piece of context:
📌 The semester was completed entirely outside Canada during COVID-era distance learning.

🧠 Our approach?
We didn't simply reapply. We challenged the refusal through a carefully prepared reconsideration request, focusing on how the officer had interpreted the requirement for “full-time student status in Canada.”

We built the case around:
✔️ The specific IRCC wording and applicable requirements
✔️ The fact that the part-time semester was an isolated exception
✔️ The extraordinary circumstances surrounding COVID-era studies
✔️ The applicant's otherwise strong, consistent full-time academic record

🏆 Result:
✅ Refusal reconsidered
✅ PGWP approved

It is key to identify why the refusal happened, where the officer's assessment may have missed important context, and whether there is a legal basis to ask IRCC to reconsider.

🎉 PGWP APPROVED EVEN WITH PART-TIME STUDIES OUTSIDE THE FINAL SEMESTER

❌ PART-TIME semester outside of the final academic term
⚠️ Major PGWP eligibility concern

✅ PGWP APPROVED

This was not a straightforward PGWP application.

The applicant completed a 4-year Bachelor of Business Administration at Memorial University of Newfoundland.

But there was one serious issue:

👉 During the FIRST semester of the program, the applicant became PART-TIME.

Normally, PGWP applicants are expected to maintain full-time student status throughout their program, except in limited circumstances such as the final academic term.

And this was NOT the final semester.

So why was the PGWP approved?

🛠 OUR APPROACH

We did not simply ignore the part-time semester or hope IRCC would overlook it.

We built a detailed legal and factual argument around exactly when, where, and why it happened.

✔️ Demonstrated that the applicant originally enrolled full-time with every intention of complying with the PGWP requirements

✔️ Explained that previously completed courses were unexpectedly accepted as transfer credits, reducing the number of courses required

✔️ Documented attempts to register in replacement courses, but available course capacity prevented the applicant from maintaining the original course load

✔️ Established that the entire semester occurred outside Canada while the applicant was studying remotely during the COVID-era facilitation period

✔️ Built a technical interpretation around the PGWP requirement to maintain “full-time student status in Canada” and how that wording applied to this unusual period of remote study

✔️ Demonstrated that this was an isolated semester, followed by years of continuous full-time studies

✅ FINAL RESULT

🎉 PGWP APPROVED

✔️ Part-time semester fully disclosed and addressed
✔️ Eligibility concerns explained through a detailed submission
✔️ 3-YEAR PGWP APPROVED

💡 THE IMPORTANT LESSON

A PART-TIME semester outside your final semester is a serious PGWP issue.

But it does not necessarily mean automatic refusal in every factual situation.

In this case, the circumstances were highly unusual because the semester occurred entirely outside Canada during the COVID remote-study period, and the reduced course load resulted from transfer credits and course availability.

👉 The outcome depended on understanding the policy, the timeline, and how the rules applied to these specific facts.

PGWP cases are not always as simple as “full-time = eligible” and “part-time = refused.”

Sometimes, the details make all the difference.
