🚨 𝗨𝗻𝗮𝘂𝘁𝗵𝗼𝗿𝗶𝘇𝗲𝗱 𝘄𝗼𝗿𝗸 + 𝘀𝘁𝘂𝗱𝘆 𝗽𝗲𝗿𝗺𝗶𝘁 𝗻𝗼𝗻-𝗰𝗼𝗺𝗽𝗹𝗶𝗮𝗻𝗰𝗲 𝗵𝗶𝘀𝘁𝗼𝗿𝘆… 𝗣𝗚𝗪𝗣 𝘀𝘁𝗶𝗹𝗹 𝗔𝗣𝗣𝗥𝗢𝗩𝗘𝗗.

This was one of the most complex cases ever.
The client had a complicated study history, including:
❌ unauthorized work during leave periods
❌ non-compliance with study permit conditions
❌ multiple program changes and academic struggles due to mental health struggles
❌ risk of being barred from a work permit for 6 months

For many applicants, issues like this can easily lead to refusal.
The key is how the case is handled.

What we did:
✔️ Fully disclosed all unauthorized work while highlighting the other strengths of the application
✔️ Provided strong supporting evidence
✔️ Provided legal arguments with reference to case law, PDIs, IRPA, IRPR, and other information

✅ Result:
🎉 PGWP approved
🎉 3-year work permit granted

Unauthorized work is not acceptable, and the same goes for study permit non-compliance.

These issues will most likely lead to refusal, but a complicated case does not always mean the end of the road.

IRCC updates processing times weekly on their website based on how long it took them to process most complete applications in the past.

As of May 20th 2026, the processing time for work permits (within Canada) is 206 days.

Some other facts to consider:
🔹It does 𝗻𝗼𝘁 include the time you need to give your biometrics
🔹Your processing time starts the day the IRCC receives your complete application, and ends when they make a decision. It may vary depending on how many applications they get, or if your application is complex
🔹Your application may be delayed or returned if it's not complete

⚠️ PGWP or work permit expiring soon?

Many people don’t realize that in some situations, you may still be able to:

✅ Change to visitor status
✅ Remain legally in Canada
✅ Work remotely for a foreign employer
✅ Gain qualifying foreign work experience for Express Entry

This can be huge because foreign skilled work experience may add up to 50 CRS points under Express Entry.

BUT there are important legal distinctions.

Simply becoming a visitor does NOT automatically authorize all forms of remote work in Canada. The work arrangement must genuinely fall outside the Canadian labour market to avoid unauthorized work issues.

She graduated and applied for her PGWP… but got refused.

Not because of her studies, but because she didn't meet the language requirement.

Then things got worse:
By the time she retook her test, she had already fallen out of status without realizing it.

⚠️ No status = no room for mistakes.

🛠️ What we did:
✔️ Applied for restoration within the 90-day window
✔️ Reapplied for PGWP within 180 days
✔️ Proved no unauthorized work or study

Most PGWP applicants must submit valid English or French language test results with their application. The required score depends on what you graduated from.

🎓 𝗕𝗮𝗰𝗵𝗲𝗹𝗼𝗿'𝘀, 𝗠𝗮𝘀𝘁𝗲𝗿'𝘀, 𝗼𝗿 𝗣𝗵𝗗 𝗴𝗿𝗮𝗱𝘂𝗮𝘁𝗲𝘀
It doesn't matter if it's a university, college, or another school as long as these degrees were offered by the school that was attended.

You need CLB 7 / NCLC 7 for EACH of these 4 skills: READING, WRITING, LISTENING, SPEAKING

No field of study requirement applies to bachelor's, master's, or doctoral degree graduates.

🏫 𝗢𝘁𝗵𝗲𝗿 𝘂𝗻𝗶𝘃𝗲𝗿𝘀𝗶𝘁𝘆 𝗽𝗿𝗼𝗴𝗿𝗮𝗺𝘀 (𝗯𝗲𝘀𝗶𝗱𝗲𝘀 𝘁𝗵𝗲 𝗱𝗲𝗴𝗿𝗲𝗲𝘀 𝗺𝗲𝗻𝘁𝗶𝗼𝗻𝗲𝗱 𝗮𝗯𝗼𝘃𝗲)

Same field of study requirement as other university programs apply.

✈️ 𝗣𝗚𝗪𝗣-𝗲𝗹𝗶𝗴𝗶𝗯𝗹𝗲 𝗳𝗹𝗶𝗴𝗵𝘁 𝘀𝗰𝗵𝗼𝗼𝗹 𝗴𝗿𝗮𝗱𝘂𝗮𝘁𝗲𝘀
No language or field of study requirement applies, but you must meet the specific flight school requirements, such as having a Canadian commercial pilot's licence or meeting the instructor rating/job offer requirement.

PGWP applications with low language scores are all getting refused, and reconsiderations aren't successful anymore either.
Don't make a simple mistake and ruin your chance to get a GPWP.

This applicant who completed a 4-year bachelor's program had one major issue:
During an earlier semester, the applicant did not meet the university's full-time threshold.

For PGWP applications, this can be a serious red flag.
❌ Part-time semester outside the final academic term
❌ PGWP ineligibility due to not meeting full-time status requirement

Although this is one of the most common PGWP refusal triggers, we took a strategic approach:
✔️ Fully disclosed the part-time semester proactively
✔️ Legal submission letter to shine light on various aspects of the application
✔️ Supporting documentation to showcase the strengths of the application

✅ Result: 3-year PGWP approved

One difficult semester does not automatically define your entire PGWP eligibility,
but how your academic history is presented matters enormously.
