When a couple separates, the home is usually the biggest shared asset and also one of the most emotional pieces of the puzzle. 😔🏠

What happens to the house in a divorce? 🧩

In Ontario, the place you lived together as a married couple is often treated as a “matrimonial home,” which gives both spouses equal rights to live there and a claim to its value, even if only one name is on title. That doesn’t mean you must sell, but you do need a plan.

Your main options ✅

🔹 One spouse buys the other out
A professional valuation or appraisal is done, you subtract the mortgage, and the spouse who’s staying refinances and pays the other their share of the equity as part of the overall settlement. Lenders often want a signed separation agreement in place before approving this.

🔹 Sell the home and split the proceeds
Both spouses sign the listing and sale documents, the mortgage and any secured debts are paid out on closing, and the net proceeds are divided according to your separation agreement or court order. This is common when neither person can comfortably afford the home alone or when both want a clean financial break.

How to prepare 📝

Before deciding whether to sell or buy out, it helps to:
* Get legal advice so you understand your rights around possession, sale, and equalization of the home’s value.
* Gather key documents: mortgage statements, property tax bills, home insurance, and any marriage/separation agreements that mention the home.
* Request a current market evaluation (and, if needed, a formal appraisal) so everyone is working from the same number.

With over 20+ years in real estate, we’ve seen this situation play out more times than we can count—and it’s never as simple as people think.

Once an offer is accepted, it’s not just a handshake… it’s a legally binding contract.

Here’s what buyers need to understand:

💸 Deposit forfeiture
If you walk away without a valid legal reason, you could lose your deposit—no questions asked.

⚖️ Potential legal action
Sellers have the right to pursue damages. That can mean being sued for:
• The difference if the home sells for less
• Carrying costs (mortgage, taxes, etc.)
• Legal fees
• Costs associated with relisting

In some cases, sellers may even try to force the deal to close.

🤝 There may be room to negotiate
We’ve also seen situations where both parties come together to find a solution—whether that’s a mutual release or another path forward. But this requires cooperation on both sides.

👉 The bottom line: backing out of a firm deal can come with serious financial and legal consequences.
