"I lost my job. Can I just stop paying child support?"

No. Arrears accumulate, MEP can suspend your license and garnish accounts, and you could face contempt of court.

What Counts as Material Change
Involuntary job loss, income reduction, disability, or legitimate retraining all qualify. Quitting voluntarily or taking lower-paying work to avoid support doesn't. Courts look at why your income changed.

How to Request Modification
Document everything immediately - ROE, EI application, job search efforts. Notify your ex in writing. File for variation within weeks, not months. Keep paying something based on EI income.

What Not to Do
Don't stop paying, ignore MEP letters, or hide employment. Every day you delay adds arrears at the full amount.

The Income Imputation Trap
Courts base support on what you should earn, not what you are. Stop job searching and your old salary may still be used in calculations.

Timeline Matters
File three months late and you owe three months of full arrears. Job loss is grounds for modification - but only if you act immediately.

Alberta's new Family Focused Protocol (FFP) came into effect January 2, 2026, requiring most parties in family law disputes to attempt alternative dispute resolution before proceeding to court.

If you're going through a separation, divorce, or custody matter right now, this likely applies to you.

Not every family law matter requires FFP compliance, but most do.

FFP APPLIES to:
✅ Divorce proceedings
✅ Parenting arrangements and custody disputes
✅ Child support matters
✅ Spousal support claims
✅ Property division cases
✅ Modification of existing orders

FFP EXEMPTIONS (May Not Apply):
❌ Cases involving family violence or safety concerns
❌ Emergency protection orders
❌ Urgent child protection matters
❌ Some enforcement proceedings
❌ Cases where one party cannot participate meaningfully

Important: Even if you think you qualify for an exemption, don't assume. The court decides whether FFP requirements apply to your specific circumstances.
