Be willing to let your lawyers "toy" with your circumstances, your goals, and the mechanisms of the law that might relate to them . That kind of "play" is not about being childish or failing to take things seriously. It is about exploring the boundaries, the edges, and the inner workings, and turning them all inside out a little, to see what they might produce that hadn't been done before.

That's often how difficult problems get solved, and the only way that seemingly impossible dreams can be realized.

A few signs that your lawyer is doing it wrong…

1. They are trying to win.

Of course, your lawyer is going to advocate for you, and will present your best case. But a lawyer who takes positions based on what they think will win, and not what’s right, isn’t doing you any service. You are always in your best position if you are in the right one; and if you are in the wrong, a good lawyer will tell you so and will then seek to get you the best outcome that your being wrong can get you.

2. They seem to know it all.

No one knows everything. If your lawyer isn’t dealing with tough questions, if they seem to never have to look things up, to double check the cases or the statutes, then they are probably, on some level, just winging it, and you should be worried. Never doubt your lawyer because they second-guess themselves; that’s a sign that they are doing it right.

3. They are “really good at arguing”.

It’s impossible the number of times an argumentative kid has been told they’d make a great lawyer. The truth is the opposite. Being argumentative is one of a lawyer’s worst qualities. Being hard to get along with, stubbourn or unreasonable are bad ones too. A good lawyer knows when lines have to be drawn, but for the most part seeks to get along with others, and earns the trust and confidence of their opponents by advocating for outcomes that are fair.
