Going through a Separation is never a simple or easy journey. Despite the feelings you may have about your ex-spouse, it is important to be reasonable in resolving your matters. The Courts will not tolerate unreasonable parties. In November 2022, I did a 7 day trial where my client was the successful party and was awarded full indemnity costs because the court found the other party's conduct to be unreasonable throughout the proceedings.

The Ontario Human Rights Commission has officially commented on mandatory vaccination.

The OHRC makes it clear that requiring vaccination, as a condition to enter the workplace and service locations is entirely permissible.

"While receiving a COVID-19 vaccine remains voluntary, the OHRC takes the position that mandating and requiring proof of vaccination to protect people at work or when receiving services is generally permissible under the Human Rights Code (Code) as long as protections are put in place to make sure people who are unable to be vaccinated for Code-related reasons are reasonably accommodated. This applies to all organizations."

“Receiving a COVID-19 vaccine is voluntary. At the same time, the OHRC’s position is that a person who chooses not to be vaccinated based on personal preference does not have the right to accommodation under the Code.”
“The OHRC is not aware of any tribunal or court decision that found a singular belief against vaccinations or masks amounted to a creed within the meaning of the Code.”

“While the Code prohibits discrimination based on creed, personal preferences or singular beliefs do not amount to a creed for the purposes of the Code”

“Organizations that are not included in the list of settings but wish to mandate vaccines are encouraged to use the provincial proof of vaccine certificate with the written documentation…showing medical inability to receive the vaccine as their way of meeting the duty to accommodate where needed”

The case of Jayawickrema v Jayawickrema, 2020 ONSC 6589 details the seriousness of cost consequences when parties act unreasonably, and fail to analyze their positions at every stage of their family law litigation matter. Justice Jarvis makes it clear that the Court will not tolerate unreasonable parties that incur exorbitant amounts of costs fighting over insignificant amounts of money.
