When you’re facing uncertainty about your family’s future, it’s natural to have questions.

Sometimes, those questions are the ones keeping you up at 2 AM.

Google and ChatGPT can be useful places to start, but general information can only take you so far. Understanding how the law applies to your particular circumstances is another matter.

Considering mediation but not sure what the process involves?

At Clarity Family Law, our mediation process is designed to help you understand the issues, prepare for productive discussions, and make informed decisions together.

Here's what you can expect:

1. The Jumpstart Mediation Package
You'll receive workbooks and instructions to help you prepare, along with an individual meeting before your first joint mediation session.
2. Joint Mediation Sessions
We'll work through the issues that need to be resolved, including parenting arrangements, finances, and property division, where applicable.
3. Progress Sessions
Most couples need three to four sessions, typically lasting about 90 minutes each. More complex situations may require additional time.
4. Separation Agreement
Once you've reached agreements on the issues, we'll prepare a separation agreement that documents your decisions. Each of you will have the opportunity to obtain independent legal advice before signing.

Mediation is about more than reaching an agreement. It's about having the information, guidance, and opportunity to make thoughtful decisions about your family's future.

Did you know that under BC's Family Law Act, we use the terms "guardianship" and "parenting time" rather than "custody"?

But while the terminology has changed, deciding how to share parenting time can still be one of the most challenging parts of separation.

Both parents may want as much time with their children as possible. At the same time, there are school schedules, work commitments, established routines, and the practical realities of everyday life to consider.

In British Columbia, parenting arrangements are guided by one key principle: the best interests of the child.

What actually happens to the house?

In this market, that might be the scariest question in the whole separation, scarier than almost anything else.

Here’s the truth: the house doesn’t automatically go to whoever’s name is on title. And it doesn’t have to be sold the day you separate.

What matters first is figuring out the equity, then how it factors into the bigger picture. From there, most people land on one of three paths.

Sell and split, which is the cleanest option but means both people are back in today’s market at the same time.
One person buys the other out, which keeps stability, especially for kids and school, but requires refinancing and a fair valuation.
Or keep it jointly for now and sell later, which is common when the timing isn’t right and gets written into the agreement.

You don’t have to decide this on day one. A temporary arrangement, who stays, how the mortgage gets paid in the meantime, can be put in writing while the bigger picture gets sorted out.

This is usually one of the first things we work through in mediation, not because people disagree, but because neither person knows their real options yet.

"Why does family law take so long?"
Because your situation is not simple.

Family law is never one-size-fits-all. The more information, the better the advice.

For example, with a separation agreement it is usually actually the end of the decision-making process, not the beginning. Good legal advice requires information.
Your lawyer is not just waiting on paperwork. Your lawyer also needs to understand your finances, your parenting situation, your goals, and your specific circumstances. Before we can draft an agreement, it's important that you understand your legal rights and obligations and that you decide what you actually want the agreement to say.

Once you’ve made those decisions, if you and your spouse are in agreement, you can move ahead with a separation agreement. If you’re not there yet, mediation can help you work through the issues that remain.
Then, once the terms are settled, the agreement can be drafted for a flat fee.

One is for before. One is for after.
Both exist because clarity at the right moment makes everything easier.

A separation agreement and a cohabitation agreement are two of the most commonly confused documents in family law, and it makes sense why.

Both deal with relationships, both are legally binding, and both require independent legal advice before signing.

But they serve very different moments.

A separation agreement comes after a relationship ends. It covers property division, parenting arrangements, child support, and spousal support.

A cohabitation agreement comes before things get complicated. It defines rights and responsibilities while you’re still together and in BC, where common law and married couples have different legal rights, it matters more than most people realize.

Neither one means you’re planning for failure. It means you’re being honest about something that matters to you and your family.

I’m Krista, the founder of Clarity Family Law.

After 11 years in a traditional law firm, I wanted to practise family law differently. I had seen how the way legal services are delivered can shape a family’s experience of separation. I wanted to be more intentional about what I offered so families could move through the process with greater clarity and even thrive on the other side of it.

Separation is difficult enough without feeling disconnected from a legal process that affects your family so directly. I wanted to create a firm where clients are informed, involved, and at the heart of the decisions being made about their lives and their families.

For me, good family law advice starts with making sure you understand what you’re dealing with. What are your options? What does the process actually look like? What could each decision mean for you and your family?

Education first. Advice second. Your decision, always.

That philosophy has shaped Clarity from the beginning. My job isn’t to make decisions for you. It’s to give you the information and advice you need to make good decisions for yourself and your family.

Outside of work, I’m part of a blended family with my husband, my two boys, and our cat. We love camping, being outdoors, and spending time together as a family.
