The latest update to the Brazilian PTO’s Trademark Manual has introduced a significant change in the elements that are subject to trademark registration. Since November, the Brazilian PTO has started accepting applications for trademark registration that include elements of advertising, such as slogans.

However, it's important to emphasize that a slogan is only eligible for registration as a trademark when it is accompanied by its distinctive element, or when the combination of advertising elements also performs a distinctive function.

The BPTO announced today in the RPI - Industrial Property Gazette the commencement of Phase V of the Patent Prosecution Highway (PPH), initially set in motion this past July.

In this new phase, the BPTO will begin accepting PPH applications whose priority does not originate from a Partner IP Office. Among the critical modifications introduced:

➡ The BPTO will acknowledge the technical examination results consisting of patentable subjects from Partner Offices, streamlining international patent cooperation.

➡ The concept of “Matter Considered Patentable” has been expanded to include subjects examined under the PCT framework, enhancing global congruency.

➡ New definitions include “Corresponding Patent Application,” “Claims Sufficiently Corresponding,” and “Narrower Claim.”

➡ The quantitative limitation on the number of participation applications using PCT results has been lifted, encouraging broader participation.

➡ New caps set the acceptance of up to 3,200 participation applications annually and up to 1,000 within the same section of the International Patent Classification.

The ordinance will come into effect on January 1st, 2025.
