The ABREU, MERKL library, which houses approximately 2,000 physical books in addition to subscriptions to online libraries, is always delighted to welcome new additions to its collection. Alongside our regular acquisitions, this month, we are pleased to welcome outstanding works authored or organized by the renowned legal scholar Manoel J. Pereira dos Santos, kindly gifted to the firm. We also celebrate the publication of Dr. Patrícia Precoma's doctoral thesis, a work of the highest academic caliber that, among its references, cites an article by our partner Maria Inez Abreu, published in a collective volume of the Intellectual Property Committee of the Brazilian Bar Association - Parana Sectional (OAB/PR), organized by our partner Marcio Merkl. Our partner Marcio Merkl published the article “SEP/FRAND: Historical Origins and the Rambus Case” in the 2026 Special Edition on SEP/FRAND, coordinated by Luiz Otávio Pimentel for the Brazilian Journal of Law (RBD). Taking an innovative approach, the article analyzes how excessive concern regarding the potential anticompetitive effects of standard-essential patents (SEPs) can have the reverse effect of disincentivizing technological innovation, and even encouraging collusive practices among members of standard-setting organizations, whether they are implementers, patent holders, or both. The RBD, affiliated with the Stricto Sensu Graduate Program in Law at Atitus, achieved the Qualis A1 classification in 2026, the highest quality rating for scientific journals in Brazil, awarded by the Coordination for the Improvement of Higher Education Personnel (CAPES).
Nosso sócio Marcio Merkl publicou o artigo “SEP/FRAND: Origens Históricas e o Caso Rambus” na Edição Especial 2026 – SEP/FRAND coordenada por Luiz Pimentel na Edição Especial da Revista Brasileira de Direito (RBD). Em uma abordagem inovadora, o artigo analisa que a excessiva preocupação sobre potenciais efeitos anticoncorrenciais de patentes essenciais pode ter o efeito reverso de desincentivar a inovação tecnológica e até mesmo incentivar a adoção de práticas colisivas por parte de membros de organizações desenvolvedoras de normas técnicas, sejam eles implementadores, titulares de patentes ou ambos. A RBD, vinculada ao Programa de Pós-Graduação Stricto Sensu em Direito da Atitus Educação, conquistou neste ano de 2026 a classificação Qualis A1, a nota máxima de avaliação da qualidade de periódicos científicos no Brasil, atribuída pela Coordenação de Aperfeiçoamento de Pessoal de Nível Superior ().

Today, 22.Jun.2026, our partner Marcio Merkl discussed the role of the "willingness" of patent holders and implementers to negotiate in global disputes over standard essential patents (SEP) and FRAND terms in a webinar of the AIPPI Standards and Patents Committee, of which he is a member. Along with Caroline Tauk (Federal Judge, TRF2nd Region, Brazil); Siddhant Sharma (Trion Law Partners, India); and Dixon Zhang (Bambu Lab, China), moderated by Federico Manstretta (IP Law Galli, Italy), they compared the approaches of their different jurisdictions, focusing on negotiation conduct, FRAND terms, injunctions, damages, and procedural issues in standards-critical patent litigation.

ABREU, MERKL participated in the Parana Section of the Law Firms Study Center (CESA/PR) meeting on the theme "Intellectual Property in Times of Major Events" with our partners Marcio Merkl, President of IP Committee of the Brazilian Bar Association - Parana Sectional (OAB/PR), as debater; and Maria Inez Abreu, Institutional Director of CESA/PR, as moderator. To complete this amazing team, the panel also included Maxime Vuille, a Swiss lawyer who worked from 2019 to 2025 at the International Olympic Committee; Peter Siemsen, partner at the prestigious firm Dannemann Siemsen, President of the Brazilian Association of Intellectual Property (ABPI) and former President of Fluminense F.C; and Alberto Goldenstein, President of Sports Law Committee of the OAB Paraná. With a sold-out event and a highly qualified audience, attendees had the opportunity to exchange experiences on broadcasting rights, brand licensing, merchandising products, ambush marketing, piracy, and other topics relevant to the current moment.
