Amigos (as), les comparto un reciente artículo titulado: «¿Cómo valorar y cuantificar el daño material (daño emergente y lucro cesante)?», el cual, luego de varios meses, pude culminarlo con ocasión de mi estancia de investigación en la Pontificia Universidad Javeriana de Colombia.

El ejercicio profesional nos demuestra que, con frecuencia, no existe claridad sobre diversos aspectos sustantivos y procesales del daño material (pasado y futuro), tales como su prueba, la legitimación activa y pasiva, la diferencia entre ingreso y ganancia, el lucro cesante en favor del cónyuge/conviviente o los hijos, la aplicación del criterio de equidad, entre otros, los cuales son abordados en el presente ensayo.
