Yesterday, our partners Andrรฉ-Pierre Andrรฉ-Dumont and Benoit Samyn hosted a bilingual seminar in collaboration with IBJ-IJE (Instituut voor bedrijfsjuristen - Institut des juristes dโ€™entreprise), focusing on recent and upcoming developments in Belgian corporate law.

In a landmark ruling of 31 August 2026, the Belgian Council of State clarified the practical impact of the Foreign Subsidies Regulation (Regulation (EU) 2022/2560) on public procurement and concession procedures. The Council confirmed that failure to comply with the FSR can result in the irregularity of the procurement procedure and the unlawfulness of the award decision.

The judgment highlights that both contracting authorities and bidders must strictly comply with the notification and declaration obligations imposed by the FSR when the applicable thresholds are met. It also confirms the European Commissionโ€™s exclusive role in assessing the impact of foreign financial contributions on the internal market.
