The High Court has sought an update on the steps taken to appoint an Information Commissioner. It has directed that the government must inform the court by November 2 about the progress made in this regard. The court also issued a rule questioning why the appointment of the Information Commissioner has not been made in accordance with the Right to Information Act.

On Sunday (August 31), following a hearing on a writ petition filed by Ajker newspaper journalist Arup Kumar Roy, a High Court bench comprising Justice Qazi Zinat Haque and Justice Ainun Nahar Siddiqa passed the order along with the rule.

Barrister Sarah Hossain, Barrister Nishat Mahmood, and Advocate Ruhi Naz represented the writ petitioner in court.

During the hearing, the petitioner’s lawyers pointed out that the country has been without an Information Commissioner for almost a year. As a result, numerous complaints remain unresolved, prompting the journalist to file the writ.

It may be noted that in the aftermath of the July movement, Chief Information Commissioner Abdul Malek and Information Commissioner Shahidul Alam Jhinuk resigned on September 5. This rendered the Information Commission virtually inactive. Later, on January 20, when the government removed Information Commissioner Masuda Bhatti, the commission became completely non-functional, leaving complaints pending without resolution.
Under the Right to Information Act, the Information Commission serves as the highest authority for settling disputes related to access to information. The law mandates that the commission must consist of a Chief Information Commissioner and two commissioners, with at least one being a woman. As per procedure, the government proposes two names for each post to the Prime Minister, who then forwards the recommendations to the President for final approval.

According to the lawyers, the Ministry of Information and Broadcasting provides secretarial support on behalf of the government, including forming the selection committee for appointing the Chief Information Commissioner and commissioners, arranging committee meetings, and preparing the list of nominees.

মার্কিন বিচারক ফ্র্যাঙ্ক ক্যাপ্রিও বিচারের ক্ষেত্রে এক নতুন আলো দেখিয়ে ছিলেন। আইনের প্রয়োগের মানবিকতা মাধ্যমে তিনি বিশ্বে এক দৃষ্টান্ত রেখে গেছেন। বুধবার, ২০ আগস্ট ২০২৫—এই মানবতার প্রতীক চলে গেলেন চিরবিদায়ে। দীর্ঘ ক্যানসার যুদ্ধে হেরে, ৮৮ বছর বয়সে শেষ নিঃশ্বাস ত্যাগ করলেন তিনি। অনলাইনের বিচার প্রচারণে কারণে বিশ্বের লক্ষ কোটি মানুষ তার ভক্ত।
আদালতে ট্রাফিক আইনভঙ্গ কিংবা ছোটখাটো অপরাধের অভিযোগে দাঁড়ানো মানুষদের প্রতি তার ব্যবহার ছিল অনুকরণীয়। তিনি শোনাতেন, সহমর্মিতা দেখাতেন, এবং আইন প্রয়োগ করতেন। সেই আইনের প্রয়োগে অন্তরে মানবতার উষ্ণতা মিশিয়ে দিতেন।
একদিন এক বৃদ্ধ ব্যক্তি তার আদালতে দাঁড়িয়ে কাঁপা গলায় বলেছিলেন—তিনি দ্রুত গাড়ি চালিয়েছেন, কারণ তার ক্যানসার আক্রান্ত ছেলেকে চিকিৎসকের কাছে নিয়ে যাচ্ছিলেন। সাধারণ নিয়মে এটি শাস্তিযোগ্য অপরাধ। কিন্তু বিচারক ক্যাপ্রিও বলেছিলেন, “আপনার স্থানে আমি থাকলে আমিও একই কাজ করতাম।” আদালতে তখন আর কোনো আসামী ছিল না—ছিল এক অসহায় বাবার বেদনা আর এক বিচারকের হৃদয়।
বিচার মানেই কেবল আইনের প্রয়োগ নয়, বিচারেও থাওতে হয় মমতার স্পর্শ। শান্তিতে থাকুন প্রিয় বিচারক।
