বাংলাদেশে মাদক নিয়ন্ত্রণ আইন সংশোধন: কঠোর শাস্তির পাশাপাশি জবাবদিহিতাও কি সমান গুরুত্বপূর্ণ?

জাতীয় সংসদ সম্প্রতি মাদক নিয়ন্ত্রণ (সংশোধন) বিল, ২০২৬ পাস করেছে। নতুন আইনে সাইবারস্পেস বা ডিজিটাল প্ল্যাটফর্মের মাধ্যমে মাদক পাচার ও বাণিজ্যের ক্ষেত্রে মৃত্যুদণ্ডকে সর্বোচ্চ শাস্তি হিসেবে রাখা হয়েছে। একই সঙ্গে প্রযুক্তিনির্ভর মাদক অপরাধ দমনে আইনটির পরিধি এবং মাদকদ্রব্য নিয়ন্ত্রণ অধিদপ্তরের ক্ষমতাও সম্প্রসারিত হয়েছে।

কঠোর শাস্তি মাদক দমনে রাষ্ট্রের দৃঢ় অবস্থানের প্রতিফলন হতে পারে। তবে আইনের শাসনের একটি মৌলিক নীতি হলো—যত বেশি ক্ষমতা, তত বেশি জবাবদিহিতা।

যেকোনো কঠোর আইন কার্যকর করার ক্ষেত্রে কয়েকটি বিষয় বিশেষভাবে গুরুত্বপূর্ণ:

•নিরপেক্ষ ও পেশাদার তদন্ত;
•স্বচ্ছ ও জবাবদিহিমূলক আইন প্রয়োগ;
•মিথ্যা বা সাজানো মামলার বিরুদ্ধে কার্যকর সুরক্ষা;
•স্বাধীন বিচারিক তদারকি এবং ন্যায়বিচারের নিশ্চয়তা।

শুধু কঠোর শাস্তি নয়, বরং ন্যায়সঙ্গত প্রয়োগ, প্রাতিষ্ঠানিক জবাবদিহিতা এবং যথাযথ বিচারিক প্রক্রিয়া নিশ্চিত করতে পারলেই আইনের প্রতি জনআস্থা আরও সুদৃঢ় হবে।

Harmony Law Consortium-এর দৃষ্টিতে, একটি কার্যকর আইন সেই আইনই, যা অপরাধ দমন করে, নিরপরাধকে সুরক্ষা দেয় এবং রাষ্ট্রীয় ক্ষমতার যথাযথ জবাবদিহিতা নিশ্চিত করে।

The session focused on the constitutional foundations of writ jurisdiction, its practical implications in public administration, and the vital role it plays in upholding the rule of law and ensuring administrative accountability.
