পিতা-মাতার ভরণপোষণ আইন ২০১৩-এর ৫ ধারার (১) অনুযায়ী, কোনো প্রবীণ ব্যক্তি তাঁর সন্তানদের বিরুদ্ধে এ ধরনের কোনো অভিযোগ আনলে এবং অভিযোগ প্রমাণিত হলে তাঁদের এক লাখ টাকা জরিমানা অনাদায়ে তিন মাসের কারাদণ্ড দেওয়া হবে। আইনে বলা হয়, কোনো সন্তানের স্ত্রী, ছেলেমেয়ে বা নিকটাত্মীয় যদি বৃদ্ধ মা-বাবার প্রতি সন্তানকে দায়িত্ব পালনে বাধা দেন, তাহলে তাঁরাও একই অপরাধে অপরাধী হবেন। ফলে তাঁদেরও একই শাস্তির মুখোমুখি হতে হবে।

এ আইনের ৩ ধারায় বলা হয়েছে, কোনো সন্তান তাঁর বাবা বা মাকে অথবা উভয়কে তাঁদের ইচ্ছার বিরুদ্ধে কোনো বৃদ্ধনিবাস কিংবা অন্য কোথাও একত্রে কিংবা আলাদাভাবে বাস করতে বাধ্য করতে পারবেন না। তা ছাড়া সন্তান তাঁর মা-বাবার স্বাস্থ্য সম্পর্কে নিয়মিত খোঁজখবর রাখবেন, প্রয়োজনীয় চিকিৎসাসেবা দেবেন ও পরিচর্যা করবেন।

আইনের ৩-এর (৭) ধারা অনুযায়ী, কোনো বাবা বা মা কিংবা দুজনই সন্তানদের সঙ্গে বসবাস না করে পৃথকভাবে বসবাস করলে, সে ক্ষেত্রে প্রত্যেক সন্তান তাঁদের দৈনন্দিন আয়-রোজগার বা ক্ষেত্রমতো, মাসিক আয় বা বার্ষিক আয় থেকে যুক্তিসংগত পরিমাণ অর্থ বাবা বা মা অথবা উভয়কে নিয়মিত দেবেন। অথবা মাসিক আয়ের কমপক্ষে ১০ শতাংশ বাবা-মায়ের ভরণপোষণের কাজে ব্যয় করবেন।

আইনের ৪ ধারা অনুযায়ী, মা-বাবার ভরণপোষণ নিশ্চিত করার পাশাপাশি দাদা-দাদি, নানা-নানিরও ভরণপোষণ করতে হবে। তবে বাবা যদি বেঁচে থাকেন তাহলে সন্তানকে দাদা-দাদির এবং মা বেঁচে থাকলে নানা-নানির ভরণপোষণ করতে হবে না।

এ আইনের অধীনে অপরাধ হবে আমলযোগ্য, জামিনযোগ্য এবং আপসযোগ্য। আদালত ইচ্ছা করলে প্রথমেই বিষয়টি আপস-মীমাংসার মাধ্যমে নিষ্পত্তির জন্য পদক্ষেপ গ্রহণ করতে পারেন। আপস-নিষ্পত্তির জন্য সংশ্লিষ্ট ইউনিয়ন পরিষদের চেয়ারম্যান বা মেম্বার কিংবা ক্ষেত্রমতে, সিটি করপোরেশন বা পৌরসভার মেয়র বা কাউন্সিলর কিংবা অন্য যেকোনো উপযুক্ত ব্যক্তির কাছে পাঠাতে পারবে। আদালত থেকে কোনো আপস-মীমাংসার জন্য পাঠানো হলে সংশ্লিষ্ট দায়িত্বপ্রাপ্ত ব্যক্তি বাবা, মা এবং সন্তান উভয় পক্ষের শুনানি শেষে নিষ্পত্তি করতে পারবেন। কোনো অভিযোগ এভাবে নিষ্পত্তি হলে তা আদালতের মাধ্যমে নিষ্পত্তি হয়েছে বলে গণ্য করা হবে।

Man mistakenly imprisoned gets bail

A victim, Nurul Islam from Sylhet, who was in jail for more than two years in place of his younger brother in a sensational murder case, got bail from the High Court today.

Nurul Islam’s younger brother Nazrul Islam alias Nunu Moulavi, who is the actual accused, has been convicted and sentenced to life imprisonment by the trial court in Madrasa student Nazrul Islam alias Dina murder case.

The HC bench of Justice Abu Bakar Siddiquee and Justice Mustafa Zaman Islam today granted bail to Nurul Islam, now 56, for next six months following an appeal filed by him seeking bail in the case, Nurul’s lawyer Mohammad Aftab Uddin told The Daily Star.

He said Nurul Islam has been suffering in jail since March 18, 2014 due to a mistake committed by the police.

He said Nurul’s younger brother Nazrul Islam alias Nunu Moulavi, who is an original accused of the case, is now absconding.

The investigation officer of the case has written the name of Nazrul Islam as Nunu Moulavi Nurul Islam in the case.

The police arrested Nurul Islam on March 18, 2014 in place of Nazrul Islam alias Nunu Moulavi, as Nurul Islam told police that his name is Nurul Islam, he said.

Madrasa student Nazrul Islam, son of Abdus Salam alias Selaiya Miah of Mewa village under Bianibazar upazila in Sylhet was killed in 1992, Advocate Aftab Uddin said.

A Sylhet court in 1999 sentenced accused Nunu Moulavi, Abdus Jalil, Abdur Rahman alias Sad, Abdus Sahid, Enam Uddin, Khalilur and Nizam Uddin to life imprisonment in the case.

Nunu Moulavi and Enam are now absconding, the lawyer added.

Mother's remarriage and custody of children

MOHIT”- is the son (five years) of a divorced couple Atiq and Rehana. Both of them remarried and demanded the custody of Mohit where he chooses to stay with his mother. But Muslim Personal Law disentitles Rehana from the custody of her son for her blunder of remarriage. What will be the fate of Mohit and Rehana?

According to the traditional Muslim Jurisprudence a father is the natural guardian of the children and in his absence, nearer male relations from paternal side. A Muslim mother can never be the guardian of her minor child rather she can claim only the custody for a very limited period which is seven years in case of male child and age of puberty is the ceiling point in case of female child unless and until she remarry a stranger, i.e; a person not within the prohibited degrees of relationship to the girl. The underlying principle behind such theory is the presumption that if she marries a stranger, the child might be treated cruelty while he/she will be treated kindly if the mother marries a person closely related to the child. But, sometimes injustice may occur if we remain sophisticated to this principle especially when the child itself wants to remain with his mother.

Our judiciary took a positive turn back from the tradition by upholding the best welfare of child doctrine. Absence of clear Quranic injunction and lack of harmony among the Islamic jurists on the rules relating to custody have enabled the Courts to take some reasonable decisions which appear constructive towards both the mother and the children. Moreover, Section 17 of the Guardian and Wards Act, 1890 also obliged the Court to consider the welfare of the minors as a paramount point in deciding the custody of a minor.

Accordingly, in Ayesha Khanum v Major Shabbir Ahmed, 46 DLR,the High Court Division of Bangladesh declared that personal law of the parties are subject to the paramount need of the welfare of the child. There is no debate regarding the fact that the welfare of the minor lies with the mother. There is no substitution of motherly love and affection and no one can substitute her and the well being and proper take care can be ensured only by mother. The assumption that mother will not take care of her own children in the event of her remarriage is not acceptable in all situation.

Thus, it is the consideration of the welfare of the minor which led the Court to take its first position in favour of the mother in the Haji Ali Baksh v Mst Baghul (15 DLR), where it was held by the Court that nobody having better title than the mother has come with this petition though she remarried after the death of her husband. Here, another claimant of the custody was the child's paternal uncle and according to Court the property of the minor is the main attraction for her uncle's demand of custody. Later on, in Akhtar Ahmad v Mst Hazoor Begum (17 DLR), the Court reiterated the observation. In Rahamatullah v Sabana Islam 54 DLR, the Court give its judgment with the underlying principle that where a widow has to remarry for the purpose of protection and shelter of the minor and herself, she should not lose her guardianship.

The judiciary of India and Pakistan also established the preferential rights of the mother to have the custody of minor child even in the event of her second marriage. References include the leading case Irfan Ahmed Shaikh v Mrs Mumtaz 1999, where the Bombay High Court affirmed that “there is no dogmatic insistence that the child must remain with the father even against the wishes of the child at the moment that the mother gets remarried to a stranger.”

These decisions of the court are some flaming examples of judicial activism in the family matters which make it feasible for lot of Mohits to get back their mother and these positive approaches of the judiciary will ultimately encourage women to claim their family rights through Court from which they are being deprived of.
