If you have completed probation and become a permanent worker, you are entitled to legal protection when your employer terminates your service.
⚠️Section 26 – Termination
▶️Notice
If you are a monthly-rated worker, you are entitled to 120 days’ written notice or wages in lieu;
If you are not monthly-rated, you are entitled to 60 days’ written notice or wages in lieu.
▶️ Compensation
If your service is terminated, you are entitled to:
30 days’ wages × each completed year of service (or part thereof in excess of 6 months).
▶️Gratuity
If you qualify for gratuity, you are entitled to:
45 days’ wages × each completed year of service,
and this is in addition to notice pay/notice period.
⚠️Section 20 – Retrenchment:
If you have served continuously for at least one year and your employer retrenches you for redundancy or shortage of work, you are entitled to:
▶️ 1 month’s notice in writing or wages in lieu of such notice; and
▶️ 30 days’ wages for each completed year of service as retrenchment compensation or gratuity, whichever is higher.
Whether it is termination under Section 26 or retrenchment under Section 20, if you are a permanent worker, you are entitled to notice, compensation, and gratuity to protect your livelihood.
HSBC Bangladesh has issued termination notices to more than 300 employees in a single day, including staff with over two decades of service. The move follows the bank’s decision to shut down retail banking from July, despite posting a record profit of BDT 1,086 Crore in 2024. Customers, depositors & student account holders now face uncertainty, while laid-off employees demand fair treatment.
