In legal terms, a Will is the legal instrument that permits a person to make decisions on how their estate will be managed and distributed after their death.
In many instances, although not all, even identifying who you want to manage your Will and who you want to benefit from your estate are the easy parts.
The harder part may come with identifying an individual’s assets and debts and more importantly, how they are owned, so that they can be correctly dealt with in a Will.
Great care must be taken when drafting a Will to ensure that the wishes of the Will maker are legal and able to be carried out and that the Will is worded and signed correctly.

What do I need to consider when becoming a TENANT?
Before entering into a Lease you should consider the following:

• You need to have a clear idea of the business you wish to conduct from the premises. The Lease will restrict you to using the premises for a specified nominated purpose only.
• Make sure you are clear about the premises you will be leasing. Which parts of the property will you have exclusive use of and which will be shared with other tenants.
• How long do you want Lease for? You will need to consider the nature of your business and determine the length that will best suit your intentions. Remember to consider your future as the sale of your business will be more attractive to purchasers if a secure Lease is in place.
• You need to ensure that you advise your Landlord within the specified timeframes if you wish to renew your Lease.
• Tenant fit-out not always included in the specified costs of the Lease and it is likely that you will be responsible for the costs of all necessary fit-out suitable for your business. You should ensure that you factor in these costs prior to signing a Lease.
• The amount of rent payable will be reviewed periodically during the term of your Lease. You should make sure you are aware of the frequency of these reviews and whether the rental amount will be reviewed to market, fixed percentage or CPI
• Will you need Landlord consent before you make any changes to the premises.

The planning zone and any overlays application to your property may dictate matters such as:
- Whether your land can be subdivided;
- How many lots you can divide your land into;
- The minimum size of each lot in your subdivision; and
- How the subdivided blocks can be used

We get it, life is busy, BUT what happens if you die without a Will?
If a person dies without a valid Will in Victoria, they are considered to have died intestate. This means the law dictates how their assets are distributed, rather than the individual's wishes.
The GOOD news? Making a Will is simple - and it puts you in control.

Just like Paulette...Separating couples can make arrangements for what
happens to their companion animals (family pets), without
going to court. This is what happens most of the time.
If separating couples cannot agree, they can apply to the
family law courts to make an order. From 10 June 2025,
when considering what order, if any, to make about family
pets, the family law courts must consider a specific list of
matters that apply only in relation to family pets.
This includes:
• any animal abuse, including threatening behaviour as
a form of family violence
• the attachment of each party, or children of the
relationship to the family pets.
The family law courts can only make certain types of
orders about family pets. The family law courts cannot
make orders for joint ownership or arrangements for
sharing possession of family pets.
