Adjudication Determinations – When a Wrong doesn’t give rise to a Right

Under the Building and Construction Industry Security of Payment Act 1999 (NSW) (SOPA), an adjudication determination for a payment claim can only be set aside on the grounds of jurisdictional error.

This is because SOPA is designed as an efficient process for contractors to be paid. Because of the expedited framework, an adjudicator’s reasons are construed generously.

Jurisdictional error is a narrow ground of review. It is not enough that the adjudicator simply got it wrong. This includes misunderstanding or misinterpreting the contract, some errors of law, preferring one party’s evidence over the other, making factual errors or giving brief reasons.

The bottom line is that unless you can point to a serious statutory defect or clear procedural failure, the design of SOPA is that even if the adjudicator has got it wrong, the determination is likely to survive. You can still duke it out in the appropriate court or tribunal but that can be cold comfort to the party on the losing end of a decision.

Last Friday, PDC Law hosted a professional learning event at Hotel Totto - “Two Sides of the Ledger: When Clients Don’t Get Paid”.

The session was presented by PDC Law’s Director, Lorri Field and Senior Associate, Victoria Absolon, who provided an insightful overview of how risk builds before, during, and after a dispute. The presentation centred around a construction scenario, analysing potential problems during a project from both the builder and suppliers perspectives.

Attendees enjoyed an informative morning of discussion, networking and valuable takeaways, including the importance of documenting and tailoring building contracts.
