Divorce and property settlement are separate things, and the deadline matters.

In NSW, you have 12 months from the date your divorce becomes final to commence proceedings in Court for property settlement. Miss the deadline and you need the court's permission to file late, which is not guaranteed.

In a de facto relationship? The deadline is 24 months from the date you separate.

If you are separating, get advice early. It is the best way to protect your position.
