You may have heard your lawyer mention an affidavit…but what actually is one? 📄

In family law proceedings, affidavits are commonly used to provide the court with evidence relevant to the issues in dispute, including in parenting and property matters 🏘️

When preparing an affidavit, it is important to provide your lawyer with as much accurate and relevant information as possible. Your lawyer can then assist you in identifying the information that is relevant to your matter and should be included in your affidavit.

Affidavits can play an important role in helping the court understand the circumstances of your matter and consider the evidence when determining the issues before it 🏛️

For more information about affidavits, check out the Federal Circuit and Family Court of Australia website 📲

Thinking about going to Court for parenting matters? A s60I Certificate may be an important first step.

In most cases, separating parents are required to make a genuine effort to resolve parenting disputes through Family Dispute Resolution (FDR) before applying to the Court for parenting orders.

That’s where a s60I Certificate comes in 📄

Issued by an accredited Family Dispute Resolution Practitioner, the certificate provides the Court with information about whether FDR was attempted, whether a party attended, or whether FDR was considered appropriate in the circumstances.

There are exceptions to the requirement to participate in FDR, including in some matters involving urgency, family violence or child abuse.

Getting advice early can help you understand what steps you may need to take before commencing Court proceedings ⚖️
