NEW PATHWAY TO PR FOR SHORT TERM 482 AND 457 VISA HOLDERS
The Australian government has introduced a new permanent residency pathway for Subclass 482 visa holders on the Short-term Skilled Occupation List who did not previously have access to PR. If you:

• held a 457 visa or were an applicant for a 457 visa on 18 April 2017 that was subsequently granted (“Specified 457 Holder”) OR
• were in Australia for at least 12 months between 1 February 2020 and 14 December 2021 and at the time of your 186 application are employed by a lawful business in Australia,

you may be eligible to apply for PR under the Subclass 186 Temporary Residence Transition stream after 1 July 2022.

Please note that if you are a Specified 457 Holder, you must have worked for at least 2 years in the 3 years immediately before the application is made holding a Subclass 457 or 482 visa. Otherwise, you must have worked for at least 3 years in the 4 years immediately before the application is made holding a Subclass 482 visa (you may need to hold 2 x 482 visas to meet this requirement).

In addition, you are also required to meet other general eligibly criteria for Subclass 186 visa such as Age, Competent English, Character and Health. If you wish to discuss your PR eligibility in detail, please contact Elmtree Migration Lawyers.

Green Light for Applicants with Refused or Cancelled Visas

The Department of Home Affairs has lifted the section 48 bar for applicants who are eligible for the Subclass 190 (Skilled Nominated Visa), 491 (Skilled Work Regional Visa) and 494 (Employer Sponsored Regional Visa). This means that if you have had a visa refused or cancelled whilst you were in Australia, and you currently do not hold a substantive visa, you may be eligible to apply for a 190, 491 or 494 visa. You can do this without having to leave Australia.

Each of the above work visas provide permanent residency or a pathway to permanent residency.
This is subject to eligibility criteria and you must be currently holding a Bridging Visa A, Bridging Visa B or Bridging Visa C.

The New Agriculture Visa

The Department of Home Affairs has introduced a new Agriculture Visa to address the worker shortage in primary industries such as horticulture, fisheries, forestry and meat processing. The Agriculture Visa is a new stream (Australian Agriculture Worker stream) of the existing subclass 403 visa.

This new Agriculture Visa supplements the existing Pacific Australia Labour Mobility Scheme and allows employers to sponsor offshore low-skilled and semi-skilled workers. It is planned that workers will be granted a 4 year visa which allows them to stay for 7-10 months per year. Following their stay, workers return home and enter Australia again for the next harvest or work season (details to follow).

To sponsor workers under the Agriculture Visa, employers will need to be accredited by (1) the Department of Home Affairs as a Temporary Activities Sponsor and (2) the Department of Foreign Affairs.

What we know about the new Agriculture Visa:
- only existing employers/labour hire companies already approved for the Pacific Labour Scheme can participate in 2021
- currently only UK workers can be sponsored. DFAT is negotiating to add certain ASEAN countries such as Malaysia and Phillipines
- new employers can apply in March 2022 to be accredited
- workers must have minimum English and be offshore
- not confirmed if workers can obtain permanent residency
- more detailed worker eligibility criteria is being drafted

PRIORITY OCCUPATIONS FOR EMPLOYER SPONSORED VISAS
Priority Migration Skilled Occupation List (PMSOL) has been updated on 27 July 2021 to include three new occupations:

• Hospital Pharmacist (251511)
• Retail Pharmacist (251513)
• Industrial Pharmacist (251512)

The PMSOL was introduced on 2 September 2020 to assist Australia’s health and economic recovery from COVID-19. The PMSOL includes occupations such as Chef, Accountant (General), Social Worker, Software Engineer, Multimedia Specialist, Registered Nurse, General Practitioner, Veterinarian, and Surveyor. The PMSOL currently has 44 occupations in total.

Through the PMSOL, the government intends to fill critical skills needed to support Australia’s health and economic recovery. Employer sponsored nomination and visa applications with an occupation on the PMSOL will be given priority processing. In addition, offshore visa holders, who have been sponsored by an eligible Australian business in any of the PMSOL occupations will be able to request an exemption from current Australia’s travel restrictions to enter Australia.

GLOBAL TALENT VISA PROGRAM - A NEW PATHWAY TO PERMANENT RESIDENCY FOR APPLICANTS WITH RECOGNISED SKILLS AND TALENTS

The Global Talent Visa (Subclass 858) provides permanent residency to applicants who have an internationally recognized record of outstanding achievement in a profession, a sport, the arts or academic/research.

The Department of Home Affairs is currently interested in applicants in the following target sectors:

To be eligible for the Global Talent Visa, an applicant must generally be under 55, be internationally recognized for their outstanding achievements, still be prominent in their field and currently command a very high salary. SECOND CHANCE FOR 485 TEMPORARY GRADUATE VISA HOLDERS

Do you hold a 485 graduate (post-study work stream) visa? You may be eligible for a SECOND graduate visa to stay in Australia for another 1-2 years.

Recently, the Australian government has added an additional stream for the Temporary Graduate (subclass 485) visa. The Second Post-Study Work stream allows some migrants already on a graduate 485 visa to apply for a second 485 visa that would allow them to stay Australia with work and study rights for an extra 1-2 years.

To be eligible, applicants must:
- Currently have their first 485 Temporary Graduate (Post-Study Work Stream) visa
- Have graduated from an Australian educational institution which is located in a “designated regional area”
- Have lived/worked/studied in a “designated regional area” for at least 2 years immediately before the time of application for a second 485 visa.

What is a “designated regional area”?
The Department of Home Affairs divides areas of Australia into three categories:
1. Category 1 (Major Cities) (NOT a Designated Regional Area): Melbourne, Sydney and Brisbane
2. Category 2 (Cities and Major Regional Centres) (Designated Regional Area): Perth, Adelaide, Gold Coast, Sunshine Coast, Canberra, Newcastle/Lake Macquarie, Wollongong/Illawarra, Geelong, Hobart
3. Category 3 (Regional Centres and Other Regional Areas): remainder of Australia.

ONLY Categories 2 and 3 are “designated regional areas”.

This means that where you choose to study on a student visa, and where you live and work on your graduate visa, can affect your visa options later on.
