Are you a victim of revenge p**n formally known as image-based abuse?

This is unauthorised public release, usually by someone you may have had a relationship, seeking revenge of intimate, indecent, or invasive images, videos, or other media produced during the course of a relationship, obtained consensually. It could also be an image or a video obtained without consent and used for such a purpose.

However such definition of image-based abuse is more specific in its application. The offence isn’t concerned with whether there is or was a relationship between the parties. It is only concerned with ā€˜the illegal distribution of intimate images between an alleged offender and the victim of any ramifications from an unlawful distribution’. The definition is given a wide interpretation such that the perpetrators don't continue to exploit their victims.

Note that the distribution of image-based materials doesn't have to be motivated by revenge. You're committing an offence if you record images to blackmail or coerce a victim; use or allow such materials to be used for sexual gratification purposes; or to use the recorded images for improper social purposes, such as by showing intimate photographs or videos of a person to other people without the permission or authority of the person whose image is being displayed/distributed.

It's also an offence to threaten to distribute an intimate photograph or a video of a person. Whether the actual distribution didn't occur, that isn't a reasonable excuse.

If you are a victim of revenge p**n (image-based abuses), please seek independent legal advice, there are laws in many different jurisdictions to protect you from such abuses.

One of the nation's toughest laws came into effect on 20 December 2024 in Western Australia.

This law gives the Western Australian Police additional powers to scan anyone for concealed weapons without a warrant.

The law was inspired by 'Jack's Law' in Queensland and aims to save lives and families from the devastating increasing knife crime across the state.

Police Officers equipped with non-invasive scanning technology will flood the streets over the busy Christmas and New Year period.

The police will be using hand-held metal detectors known as 'wands' to scan the outer layer of a person's clothing anywhere anytime.

Apart from the busiest business districts, events or music festivals will also be targeted.

Anyone caught with an edged weapon could face up to three years in prison and a $36,000 fine.

If you are caught with edged weapons and have a 'lawful excuse', you will continue to have a legitimate reason for carrying a knife and this shields you from prosecution. "Lawful excuse" includes being a tradie and you use an edged weapon for the purpose of your employment. Possession for self-defence is not considered a lawful excuse.

Please note that it is an offence to refuse to undertake a scan or produce an object when requested by a police officer. Failure to comply may result in up to 12 months in jail and/or fine of up to $12,000.

From our team at Sentry Legal, we wish you a Merry Christmas and a Happy New Year.

Are you a Red P-plate driver?

From today (1st Dec 2024) all Red P-plate drivers are limited to carrying one passenger in their motor vehicles at all the times.

Please note that curfew on red P-plate driving between midnight and 5am will continue to apply.

The penalty for breaching red P-plate passenger restrictions is a fine of $200 plus two demerit points, which is the same as for driving during the existing red P-plate curfew.

This law seeks to reduce deaths and serious injury in Western Australian roads. Statistics showed that novice drivers (18-19 yrs) have the highest Killed or Seriously Injured (KSI) rate compared to other age groups (Western Australian Road Fatalities and Serious Injuries 2023 report).
