If you've been named as an executor or administrator of a loved one's estate, you may have heard the term "transmission application", but what does it actually mean?

Put simply, a transmission application is the legal process that allows the person in control of a deceased estate to transfer the deceased's share of a property to the correct beneficiary or beneficiaries.

In WA, there are two types:
- Executors (nominated in a will and granted probate) must complete a transmission application before they are able to transfer property to beneficiaries or, depending on the will’s terms, sell the property and distribute the funds.

- Administrators (appointed by the court through Letters of Administration when there is no will) have the same powers to transfer or sell property as part of estate administration.

Getting this step right is fundamental to processing a deceased estate.

✅ Finance approval deadline
This is the date by which you must have formal loan approval from your bank. Miss it? The seller may cancel the contract, and you could lose your deposit.

✅ Building inspection date
This is your window to arrange a professional building and pest inspection. If issues are found, you may need to renegotiate or withdraw. Miss this date? You lose that right.

✅ Settlement day
The big one. This is when funds transfer, documents are lodged, and keys change hands. Delays can mean penalty interest or even contract termination.

Heads up, things are changing from 1 July.

From 1 July 2026, new Anti-Money Laundering and Counter-Terrorism Financing (AML/CTF) laws will come into effect for conveyancers across Australia.

What does this mean for you?

When you buy or sell property with us, we'll need to:
✅ Verify your identity in more detail
✅ Ask more questions about the source of funds
✅ Keep additional records

Why?

These laws are designed to help prevent financial crime and money laundering through property transactions. Real estate is, unfortunately, "widely exploited" to wash illegal money.

Will other professionals ask the same?

Yes. This applies to ALL conveyancers, lawyers, real estate agents, and accountants from 1 July.
