⚖️ Summons, Bail, Remand ⚖️
❓What is the difference❓
When you are charged with a criminal offence the Police have a number of options with respect to bringing your matter before the Court. They may:
Issue a Charge and Summons requiring you to attend at court on a specified date;
Charge you and bail you on your own undertaking with or without conditions to appear at court on a specified date;
Refuse to grant you bail, in which case they must take you to Court to give you the opportunity to make an application for bail before a Magistrate.
Summons
A summons is where the court is ordering you to come to court to answer the charges.
Bail
Bail is a process that allows a person to be released into the community after being arrested and charges with a criminal offence with certain conditions. Some of these conditions may include:
• Agreeing to come to court when the matter is heard.
• Not contacting witnesses.
• Regularly reporting to a police station.
• Living at a particular address.
• Providing a surety
• Abiding by a curfew
• Undergoing rehabilitation
Remand
Remand is where an accused person is not released on bail and is instead held in custody. At this time, there will be an opportunity to apply for bail as the accused must be brought before a Magistrate if bail is not granted or refused by Police.
