A child's views can be relevant when a Court is considering parenting orders — but they are one factor among a range of considerations.

The weight given to a child's views can depend on factors including their age and maturity, whether their views have been influenced by a parent and the particular circumstances of the case.

Aston Legal Group's case study of Solghi & Danwar [2022] demonstrates how this can work in practice. In that matter, the Court gave significant weight to the children's views, taking into account their maturity, their own experiences and the broader circumstances, including family violence.

The key point is that there is no automatic rule that a child's preference determines the outcome.

The Court's focus remains on the best interests of the child.

When a child is not returned as agreed, the situation can become urgent very quickly.

In a recent Aston Legal Group case, our client engaged us two days after the child was not returned. After attempts to resolve the matter were unsuccessful, our office filed an urgent application seeking the child's recovery. The matter was listed for hearing within seven days.

After considering the Court documents and a Department report, the Senior Judicial Registrar indicated that the child should be returned to the father. Following negotiations, consent orders were reached and the child was returned to our client that same afternoon.

The case involved a complex history of family violence, risk allegations and child protection involvement, demonstrating why urgent parenting matters require careful legal assessment.

A Binding Financial Agreement isn't only something people think about before getting married.

Under Australian family law, a BFA can be entered into before, during or after a marriage or de facto relationship. It can address matters including property, financial resources, spousal maintenance and superannuation.

There are also important legal requirements, including independent legal advice for each party and requirements around signing, writing and disclosure.

A contested Intervention Order matter can involve extensive evidence and detailed cross-examination.

In this Aston Legal Group case, our clients were the respondents in Personal Safety Intervention Order applications brought in the Magistrates’ Court of Victoria at Sunshine. The matter involved allegations of stalking and other prohibited behaviour.

During the hearing, Aston's Principal Lawyer cross-examined the applicant for approximately two hours, including on inconsistencies in her evidence and further and better particulars.

The Court ultimately:

• Refused to grant Final Orders against the respondent husband
• Refused to grant a Final Order against the respondent wife
• Reinstated a Final Order in favour of the respondent wife and her children
• Made a costs order in favour of the respondent husband
