At least 6.5 million Australians risk having their superannuation paid to someone other than their intended beneficiary.

Only one in four Australians are confident they have a legally binding nomination in place for their superannuation, while more than a third have not made any nomination at all.

Although commonly used, non-binding nominations may not ensure a person’s wishes are followed if a dispute occurs.

It’s been a while, so let me reintroduce myself (with a pic of my two little soulmates).

I’m Sahnay — lawyer, problem‑solver, mother, wife and proud pet mum.

If there is one thing I wish more people would do…

𝗚𝗲𝘁. 𝗬𝗼𝘂𝗿. 𝗦𝘂𝗽𝗲𝗿𝗮𝗻𝗻𝘂𝗮𝘁𝗶𝗼𝗻. 𝗕𝗶𝗻𝗱𝗶𝗻𝗴. 𝗗𝗲𝗮𝘁𝗵. 𝗕𝗲𝗻𝗲𝗳𝗶𝘁. 𝗡𝗼𝗺𝗶𝗻𝗮𝘁𝗶𝗼𝗻. 𝗜𝗻. 𝗣𝗹𝗮𝗰𝗲.

For many people, superannuation is their biggest asset after the family home, but it doesn’t follow the normal rules that apply to bank accounts or real property.

The last thing you want is your family stuck in limbo while a super fund takes weeks to respond.

Even if you’ve named a beneficiary, the fund doesn’t have to follow your wishes unless the nomination is ‘binding’.

And that’s before we even get to the tax consequences - for example, nominating someone who isn’t a financial dependant (like an adult child as opposed to a minor child or spouse) could leave them with a hefty tax bill.

So please - spend 5 minutes this weekend and get it sorted - thanks!

And ideally, get advice about who to appoint and make sure your nomination is actually valid.
