Buying a property wasnโ€™t always as straightforward as signing a contract and settling on a date...

Before modern land title systems, proving who owned a piece of land could be complicated, with ownership often recorded through lengthy deeds and documents.

In SA, the introduction of the Torrens title system in 1858 changed the way land ownership was recorded. Instead of relying on a chain of private deeds, ownership was registered on a central title, creating a much clearer system for buying, selling and transferring property.

Fast forward to today, and while the process is far more streamlined, the principle remains the same: making sure ownership is transferred correctly and your interests are protected.

In SA, most private property sales include a clear two-business-day cooling-off period, giving buyers time to reconsider their purchase.

If you decide not to proceed, you can withdraw by giving the required written cooling-off notice within the timeframe, and you donโ€™t need to give a reason.

There are some important exceptions, including properties purchased at auction or on the same day as an auction.

There are other factors to consider when it comes to cooling-off rights, which is why we recommend involving your conveyancer as early as possible when buying a property. We can provide advice, protect your interests and help you make informed decisions throughout the buying process.
