Who would speak for you?

An important part of estate planning is deciding who you trust to make decisions if you are unable to make them yourself.

This is where documents such as an Enduring Power of Attorney and Advance Health Directive can become so important.

But the document is only one part of the process.

The person you choose should understand your values, your wishes and what quality of life means to you. They should be someone who can make calm, thoughtful decisions at a difficult time.

These conversations are not always easy. But having them early can give clarity to your loved ones and comfort to you.

Does tax matter in estate planning? Absolutely.

But should it be the starting point?

In my experience, the answer is no.

The most important estate planning conversations are about people—their family, their values and what they hope to achieve. Tax is an important consideration, but it should support those goals rather than determine them.

🎉 Testamentary Trusts Exempt from Proposed Trust Tax Changes 🎉

This is welcome news for Australian families and estate planning professionals.

The Federal Government has confirmed that all testamentary trusts will be excluded from the proposed minimum tax for trusts, preserving an important estate planning tool used by families across Australia.

Why does this matter?

✅ Protects vulnerable beneficiaries

✅ Supports effective succession planning

✅ Preserves flexibility for future generations

✅ Provides certainty for families preparing their Wills and estates

Testamentary trusts have long played a critical role in helping families manage and protect assets after death. The confirmation that these arrangements will remain exempt is a sensible and practical outcome.

We’ve had a LOT of questions recently about whether testamentary trusts are still worthwhile following the Government’s proposed changes to discretionary trust taxation.

The short answer?

Yes.

While the proposed changes may impact some tax outcomes in the future, testamentary trusts have never been just about tax.

They remain an incredibly valuable estate planning tool for many families because they can help with:

✔️ Protecting vulnerable beneficiaries
✔️ Safeguarding inheritances for children and grandchildren
