A Consent Order is a Court Order sealed (stamped) by the Federal Circuit and Family Court of Australia that is legally binding and can deal with the care arrangements of children (or grandchildren as an example) or your finances, following the breakdown of a de facto or marital relationship. A Consent Order can be made for Interim Orders, meaning they can be changed by agreement or a further Order of the Court, or Final Orders where your dispute has been resolved and concluded.

When hearing an Application for a Protection Order in Queensland, the Court has the power to make a Temporary Protection Order (TPO), which comes into effect as soon as the Respondent (person committing the domestic violence) becomes aware of the Application and TPO, or it is served on them by police.The TPO stays in place during the course of the proceedings and will come to an end when either the Court makes a Final Order, typically for a period of 5 years or, the Court dismisses the Application as it does not meet the required criteria. Alternatively, the Application may be withdrawn by the Aggrieved.

In order for an act to be considered an act of Domestic Violence the two people must first be in a relevant relationship. A relevant relationship falls into three categories and they are outlined in section 13 of the Domestic and Family Violence Protection Act 2012 (QLD) and they are: 1. A spousal relationship; or
2. An engagement relationship; or
3. A couple relationship.
