Contract Tip: What’s actually included in your property purchase?

It’s a common assumption that everything you see in a property stays with it once it’s sold — but that’s not always the case.

Just because an item is physically present during an inspection does not automatically mean it forms part of the sale. In property law, inclusion depends on what is clearly set out in the contract and what is considered a fixed fixture.

This is where misunderstandings often arise. Items such as dishwashers, fridges, washing machines, and wall-mounted TVs are frequently assumed to be included, but they may be removed unless specifically agreed upon in writing.

As a general rule:
If it is not permanently fixed to the property, or not expressly listed in the contract of sale, it is not guaranteed to stay.

To avoid uncertainty, it is important that all inclusions are clearly documented before signing. A careful review of your contract can prevent unexpected surprises and ensure both parties are on the same page.
