Ever heard the term 'vacant possession' and wondered what it actually means?

To simplify, vacant possession means that when settlement takes place, the property must be:
✔️ Empty of the seller's belongings (unless included in the contract).
✔️ Free from occupants, meaning no one is living there unless the contract says otherwise.
✔️ Ready for the buyer to move in and enjoy.

In most residential sales, buyers expect to receive the property with vacant possession on settlement day. If this doesn't happen, it can delay settlement or lead to legal complications.

Having your offer accepted is an exciting milestone, but there's still plenty to do before you can call the property your own.

Here's what happens next in NSW:

✔️ Contact your conveyancer or solicitor as soon as possible.
✔️ Review the Contract for Sale and any inspection reports.
✔️ Arrange your pest and building inspections (if applicable).
✔️ Finalise your finance and let your lender know the contract has been accepted.

Remember, in NSW an accepted offer doesn't automatically mean the property is yours. Until contracts are exchanged, either party can generally walk away (unless you're buying at auction, where different rules apply).

A common question we hear is: "Does that stay with the house?" 🤔

In NSW, fixtures are generally included in the sale unless the contract says otherwise.

Fixtures are items that are permanently attached to the property, such as:
✔️ Dishwashers
✔️ Light fittings
✔️ Curtains and blinds
✔️ Built-in wardrobes
✔️ Bathroom vanities
✔️ Fixed air conditioning units
✔️ TV Wall brackets (TV excluded)

Items that are not permanently attached (known as chattels) usually don't stay. Think:
❌ Freestanding fridges
❌ Washing machines
❌ Microwaves
❌ Outdoor furniture
❌ Pot plants (unless agreed otherwise)

If you're ever unsure whether something is included, ask the question before exchanging contracts. If it's important to you, it can often be specifically included (or excluded) in the contract to avoid any surprises at settlement.
