Signing a commercial lease? What will ‘make good’ actually mean for you?
Imagine investing in a stunning fit-out for a beautiful retail store with custom fitting rooms, beautiful finishes and two huge chandeliers.

The space looks incredible. Then the lease ends.

The ‘make good’ clause requires a complete de-fit, including removing those chandeliers, taking out the fit-out and repainting the premises plain white.

Essentially, you're returning it to a fresh, blank space for the next tenant. Suddenly, ‘make good’ doesn't sound like such a small clause.

Depending on your lease, complying with your make good obligations can involve significant cost, time and effort at the end of your tenancy.

That's why it's important to understand what your lease requires before you sign, not when you're preparing to move out.

Buying a business? How long is left on the lease? When you're buying a business that operates from leased premises, one of the things that can easily be overlooked is how long is actually left on the lease.

Here's why it matters.
Imagine you're buying a business from premises that are central to how that business operates, but only six months remain on the lease.

What happens after those six months? Is there an option to extend? Has that option been exercised? Does an extension need to form part of the business purchase?

Suddenly, the lease becomes a pretty important part of the conversation.
That's why when we're reviewing a business purchase, we also look at the lease arrangements. The remaining term, any options to extend and the timing around those options can all be important to understand before moving forward.

It's easy to focus on buying the business itself. But if that business relies on its location, you also need to understand what's happening with the premises.

A different kind of teamwork. We like to work as a team in the office, on the field, and even to help people we're unlikely to ever meet.

A few of us regularly donate blood through Lifeblood, and we've even created a Finch Legal Lifeblood team. One of the really rewarding parts is getting that little text afterwards letting you know where your blood has been used.

It's pretty special knowing that something we can do together as a team may help someone else when they need it. And, of course, we all know one of the best parts of donating... the little snacky snackies afterwards. 😂

Becoming a guarantor? Know what you're committing to. Helping your child purchase a property can be a wonderful thing to do, but it's important to understand the commitment you're making.

Generally, the bank will put a mortgage against the guarantor's property as part of the guarantee arrangement.

This may affect your:
🔹 borrowing capacity
🔹 ability to sell or transfer the property
🔹 financial plans for the future

Becoming a guarantor is a significant financial commitment. Before signing, make sure you understand exactly what you're agreeing to and how it could affect you.
