HAVE YOU BEEN IN A MOTOR ACCIDENT IN NSW? The laws are tough and can be difficult to navigate.
If your accident occurred after 1 December 2017 you have 3 months to lodge your claim, using a prescribed form being an Application for Personal Injury Benefits. You otherwise need to provide the insurance company a ‘full and satisfactory explanation’ for the delay.
If you have lost income because of your accident, you need to lodge your claim even earlier, within 28 days. Otherwise you may lose your right to recover income until you have lodged your claim with the insurer, and again the law requires providing a full and satisfactory explanation for the delay.
If you have been in a motor accident, you also need to report it to the police within 28 days. We strongly recommend that you report it to the police immediately and obtain an event number.
If you have suffered from injuries that are considered to be "non minor" (now classified as “non threshold” injuries) at law, you could be entitled to recover significant damages.
