Mr. H. and his wife first met in May 2022, married in April 2024, and lodged the Partner Visa application in the same month - with dependent applications included for his 2 children under 18.

During the processing period, the Department of Home Affairs issued a Section 56 Request for Further Information - a step that is not uncommon in the visa assessment process, but one that requires the applicant to read the request carefully, prepare the appropriate documentation, and respond within the specified timeframe to avoid any impact on the progress of the application.

Preparing your own Australian visa application: cost saving or higher risk?

When preparing an Australian visa application, many people think: “My case isn’t too complicated, I can just read the instructions and do it myself. That way I stay in control and save money.”

This can be reasonable for some straightforward applications, where you clearly understand the requirements of the visa you are applying for and have enough time to study the relevant rules carefully.

However, Australian migration law is a very broad system, with different criteria and conditions for each visa subclass, and it can change over time. Even a small point that is misunderstood, omitted or presented inconsistently can affect the outcome of the application.

Below are three risks you should consider before deciding to prepare your application on your own.

1. Visa application charges are usually not refunded if your visa is refused

The Australian Visa Application Charge (VAC) is now a significant cost. For example, for a Partner visa 820 the government application charge alone is currently AUD 11,710.00.

Under migration law, if an application is refused because the criteria are not met, required documents are missing, or there are problems in the information provided, the VAC that has been paid will normally not be refunded.

This means that if your case has not been assessed carefully before lodgement, the “saving” from not using professional support at the beginning can turn into a much larger loss if the application runs into difficulty.

2. Your ability to apply again for some visas in Australia may be affected

Another risk that many people do not notice is that your current visa status and the timing of your new application can affect what options you have later.

For example, if your visitor visa has already expired and your new visa application is refused while you are still in Australia, in some situations a restriction can arise on lodging certain further visa applications while you remain in Australia. This is commonly referred to as a Section 48 bar.

When this happens, your choices for applying for visas from inside Australia can become more limited. Your study plans, work plans, or plans to stay longer in Australia may be affected and need to be reassessed.

Do I have to hire a lawyer or migration agent when applying to the ART for a review?

This is a very common question, especially for people whose visa has just been refused and who are worried about costs.

The short answer is: no. You are not required to hire a representative to apply to the Administrative Review Tribunal (ART) for a review. You may deal directly with the ART and represent yourself, or you may ask someone to assist or represent you during the review process.

However, it is important to understand who may represent you and who may charge a fee.

The ART states that you may arrange for a registered migration agent or an Australian lawyer who holds a practising certificate to represent you. A close family member - such as your spouse, child, parent, brother or sister—or the person who nominated or sponsored you may also represent you. However, only a registered migration agent or an Australian lawyer who holds a practising certificate may charge you a fee for representing you.

This is important because some people may seek help from services that are not authorised to provide paid migration advice or paid representation. Before paying anyone, you should check whether they are a registered migration agent or an Australian lawyer with a current practising certificate.

Whether you choose to obtain professional help depends on your circumstances. If the matter is relatively straightforward, the refusal reasons are clear, and you understand the ART process and time limits, you may decide to represent yourself.

However, you may wish to seek help from a qualified professional if your matter involves:

+ Complex visa history.

+ Conflicting or missing information.

+ Difficult legal or factual issues.

+ A large amount of evidence or written submissions.

+ A hearing at the ART.

+ A decision that may have a serious impact on your ability to remain in Australia.

A representative may communicate with the ART for you, provide written evidence and submissions, request access to review documents, and attend a hearing with you. However, hiring a representative does not guarantee that the ART will make a favourable decision.

Most importantly, check the decision letter from the Department of Home Affairs as soon as possible. ART review time limits are strict, and the ART may have no power to extend the time limit for some migration matters. Your decision letter should state whether the decision can be reviewed, who may apply, and the deadline for lodging an application.

Why shouldn’t you wait until your visa is about to expire before preparing your application?

Visa application charges are usually paid online through an ImmiAccount. If you wait until your visa is almost expired before lodging, you may face unexpected situations such as:
