Great news. Last Tuesday the Federal budget revealed a plan that Australia is set to welcome 1.495 million new migrants over the next five years. This is a once-in-a-lifetime opportunity for hundreds of thousands of people from all over the world aspiring to migrate to Australia.

Applicants with the following attributes stand a better chance:

(i) Age is less than 45 years

(ii) Competent or even better Proficient English ( proficient English is in IELTS - 7 in each band or in PTE - 65 in each band)

Just a week after jobs and skills Summit, NSW Government published its Skill Occupation list this week for the year 2022-2023.

The result is surprising. While some professional occupations like Accountants need 110 points and 3 years full time experience and Civil Engineers need 105 points to be eligible for 190 visa, trade occupations like Carpenters need only 70 points, welding and Sheet metalworker need only 65 points. Electrician, Plumber, Tiler all need less points. Good news for Tradies. Good news for Café Managers too!!!

Visa Application Fee Increase:
All visa application fee increase by 3% from 01 July 2022

Important Change to the TRA Skill Assessment Job Ready program (JRP)
From 01 July 2022, all JRP application will follow three step JRP process.

Age Exemption for Legacy 457 Employees to Apply Permanent Residency 186 Visa!!!
The Age exemption also applies from 01 July 2022 for two years for those applicants who hold their visa from 18 April 2017. Eligible applicants need to be in Australia for at least one year between 01 February 2020 and 14 December 2021.

Good News for 482 Visa Holders on the STSOL List
The uncertainty is finally over.
In recognition of the extraordinary contributions that the 482 visa holders made during the difficult time of the Pandemic, Australian Government is changing law allowing even the 482 visa holders on the STSOL list to apply for permanent residency from 01 July 2022. But this option will be open for two years only. Eligible applicants need to be in Australia for at least one year between 01 February 2020 and 14 December 2021.

Good news for the 485 Visa Holders
Travel restrictions and border closure during pandemic caught a lot of people off guard!!! 485 Visa holders who were stuck overseas were deprived of the advantage accorded by this visa allowing one to work full time. So those affected applicants will be given another opportunity to apply for a second 485 visa. A temporary concession is also available for 485 visa holders on the Graduate work stream. From 01 July 2022 to 30 June 2023, 485 visa holders on the Graduate stream will not be required to obtain a skill assessment!!!

AAT Fee Increase:
The cost of visa refusal will be more expensive from 01 July 2022. The appeal fee is increased to $3153.00. This is why, to avoid costly mistake, it is important to seek professional advice from an experienced immigration lawyer.

Our client is a skilled Engineer. We lodged our client’s Nomination and Visa application only last week. We have received both Nomination and Visa approval today which is within 6 days of lodgment. We worked extremely hard with our clients ( both sponsor and the visa applicant alike) over the period of last few months and finally our months of hard work have borne fruit today!!! The critical factors in getting this quick decision are submitting a decision ready application with convincing submission and the fact that our client’s occupation is currently on Australia’s Priority Migration Skilled Occupation List ( PMSOL). (i) Currently NSW 491 Nomination is open only for onshore applicants. An onshore candidate can satisfy the criteria for NSW 491 Nomination through 3 different pathways: (1) living and working in regional NSW, (2) Recently completed study in Regional NSW, and (3) Skilled Occupation required in Regional NSW

(ii) A candidate who lives and works in regional NSW can apply to any region through pathway 1 if the occupation is on the relevant list.

(iii) However, a candidate wishes to apply through either pathway 2 or 3 is required to see whether the occupation is on the relevant region’s particular list.

(iv) What this means is that whereas pathway 1 is generic, pathway 2 and pathway 3 is region-specific in terms of the occupation list.

(v) Therefore, before lodging a ROI it is extremely important for applicants to see the region-specific occupation list under pathway 2 and 3 and then lodge the ROI in line with the list.

(vi) Due to the time constraint, it is equally important to be prepared for lodging visa application with a decision ready checklist following invitation.

There have been some changes to the NSW Skilled Occupation list for 190 and 491 visa. The list is not surprising given the recent recommendations made by the National Skills Commission on skill shortage in Australia.

We believe that the introduction of submission window in the processing stage would provide more certainty to the 491 applicants in lodging their visa application. An applicant meeting the criteria for the 491 visa can expect even a quicker processing time under the new system given that following selection and invitation from the submission window an applicant could directly apply to the Regional Development Australia (RDA) within 14 days of the invitation. The critical thing to remember is to be prepared in advance for the Submission Window round. For 2021-22 financial year, the submission windows will be open in the months of August, October, January and March.

The months of May and June has brought important updates for aspiring applicants interested about migration to Australia. We are taking this opportunity to keep our readers informed about the latest updates in Immigration Law.

Funding Boost for Administrative Appeals Tribunal (AAT)

The Government will provide $54.8 million over four years from 2021-22 to address the backlog of cases at the AAT. We believe this funding will bring the much-needed relief to thousands of review applicants and their families in Australia who have been eagerly waiting for their matter to be heard at the Tribunal.

Skilled Migration

The Government will maintain the 2021-22 Migration Program planning level at 160,000. This year because of the pandemic the focus would be on onshore visa applicants. Even the onshore partner visa applicants can expect a quicker processing time. We stress the important of lodging a decision ready application with solid and convincing evidence presenting in a logical, structured, and coherent manner.

Business Visa (Closure of 132 visa and 188 Premium Investor Stream)

From 01 July 2021, Business visas (subclass 132) and Subclass 188 (Premium Investor Stream) will cease to exist. Unfortunately, Business Innovation Visa will have higher asset and turnover requirements.

Good News for 408 Visa Applicants:

To address the acute skill shortage of labour in agricultural sector, 408 visa applicants will be given the opportunity to stay in Australia by extending their visa if they are willing to work in agricultural sector.

4 Years Waiting time for Government Benefit:

Anyone obtain permanent residency after 01 January 2022 will need to wait for four years before they could be eligible for Government benefits like Centrelink payments.

Situation of onshore and offshore students

Currently onshore students can work unlimited hours if they work in hospitality, tourism, and agriculture. For offshore students, the border is expected to reopen from July 2022. However, under a pilot plan preferential access may be arranged for international students willing to return to Australia. The number allocated under the pilot plan is initially 250 students per fortnight with a plan to double the number by the end of this year. All international students who are currently studying offshore can apply for Temporary Graduate Visa (Subclass 485) after completion of their study as an exception allowed under the pandemic.

Priority Migration Skilled Occupation List (PMSOL):

What a great news for Chef, Accountant and Auditor. The Government has announced that Chef, Accountant and Auditor would be included in the Priority Migration Skilled Occupation List. To address the skill shortage in Engineering sector, civil engineering, structural engineering, geotechnical engineering and some other stem occupations would also be included in the list.

Global Talent Visa :

This year The Government will reduce the number of Global Talent Visas from 15000 to 11000. As the competition is fierce, there is no alternative of lodging a decision ready application with a completed form 1000 where applicant’s record of professional and educational achievement needs to be attested by a Nominator.
