The months of May and June has brought important updates for aspiring applicants interested about migration to Australia. We are taking this opportunity to keep our readers informed about the latest updates in Immigration Law.
Funding Boost for Administrative Appeals Tribunal (AAT)
The Government will provide $54.8 million over four years from 2021-22 to address the backlog of cases at the AAT. We believe this funding will bring the much-needed relief to thousands of review applicants and their families in Australia who have been eagerly waiting for their matter to be heard at the Tribunal.
Skilled Migration
The Government will maintain the 2021-22 Migration Program planning level at 160,000. This year because of the pandemic the focus would be on onshore visa applicants. Even the onshore partner visa applicants can expect a quicker processing time. We stress the important of lodging a decision ready application with solid and convincing evidence presenting in a logical, structured, and coherent manner.
Business Visa (Closure of 132 visa and 188 Premium Investor Stream)
From 01 July 2021, Business visas (subclass 132) and Subclass 188 (Premium Investor Stream) will cease to exist. Unfortunately, Business Innovation Visa will have higher asset and turnover requirements.
Good News for 408 Visa Applicants:
To address the acute skill shortage of labour in agricultural sector, 408 visa applicants will be given the opportunity to stay in Australia by extending their visa if they are willing to work in agricultural sector.
4 Years Waiting time for Government Benefit:
Anyone obtain permanent residency after 01 January 2022 will need to wait for four years before they could be eligible for Government benefits like Centrelink payments.
Situation of onshore and offshore students
Currently onshore students can work unlimited hours if they work in hospitality, tourism, and agriculture. For offshore students, the border is expected to reopen from July 2022. However, under a pilot plan preferential access may be arranged for international students willing to return to Australia. The number allocated under the pilot plan is initially 250 students per fortnight with a plan to double the number by the end of this year. All international students who are currently studying offshore can apply for Temporary Graduate Visa (Subclass 485) after completion of their study as an exception allowed under the pandemic.
Priority Migration Skilled Occupation List (PMSOL):
What a great news for Chef, Accountant and Auditor. The Government has announced that Chef, Accountant and Auditor would be included in the Priority Migration Skilled Occupation List. To address the skill shortage in Engineering sector, civil engineering, structural engineering, geotechnical engineering and some other stem occupations would also be included in the list.
Global Talent Visa :
This year The Government will reduce the number of Global Talent Visas from 15000 to 11000. As the competition is fierce, there is no alternative of lodging a decision ready application with a completed form 1000 where applicant’s record of professional and educational achievement needs to be attested by a Nominator.
