BINDING FINANCIAL AGREEMENT (BFA)

What is a BFA?

A BFA is a legally binding contract entered into by both parties in a relationship, which sets out the handling of property, finances, and other things such as spousal maintenance in the case of a relationship breakdown.

A BFA can determine the distribution of property, assets, and debts, as well as whether ongoing financial support or payments will be provided.

BFA's can be entered into at any stage of the relationship.

Why is a BFA important?

A BFA removes Court involvement and allows both parties to have a say in the distribution of their property and assets in the case that the relationship was to breakdown.

Having a BFA in place removes the need to spend thousands of dollars going through the Court system for an outcome that neither party may desire.

Overall benefits of a BFA include:
- Avoid Court involvement. Saves time and money.
-Provides certainty and control.
-Protects assets. Especially important for those who own businesses, have significant assets upon entering the relationship or those who have children from a previous relationship.
-Private. Court proceedings can become public. BFA's remain private between the parties.
