NSW landlords: you canโ€™t just ask a tenant to leave anymore.

Since 19 May 2025, NSW rental laws require landlords to have a specific legal ground to end a tenancy.

That means โ€œI donโ€™t want to renewโ€ or โ€œI want a different tenantโ€ isnโ€™t enough.

Depending on the circumstances, you may need to make sure you have:

โ€ข The correct termination ground
โ€ข The right notice period
โ€ข The required supporting evidence
โ€ข The correct process followed from start to finish

Getting it wrong can lead to delays, additional vacancy risk, stress โ€” and potentially NCAT.

The important part? Donโ€™t issue the notice first and figure it out later.

You are frustuated, furious, upset and worried. You have mortgage repayment to cover and you have no rental income!

The right approach is to follow the proper process, keep a complete paper trail, and make sure your property manager is actively managing the arrears.

One thing I strongly recommend to every investor: ๐ก๐š๐ฏ๐ž ๐š๐ฉ๐ฉ๐ซ๐จ๐ฉ๐ซ๐ข๐š๐ญ๐ž ๐ฅ๐š๐ง๐๐ฅ๐จ๐ซ๐ ๐ข๐ง๐ฌ๐ฎ๐ซ๐š๐ง๐œ๐ž. The right policy may protect you against certain rent arrears and other losses, depending on your cover.

Also, donโ€™t underestimate the importance of having a financial buffer. Property investing comes with risks, and tenant default is one of them.

If your property manager isnโ€™t chasing the arrears, keeping you updated and explaining exactly what theyโ€™re doing, itโ€™s time to ask questions.

Because the longer you leave it, the more expensive the problem can become.

At the end of the day, good property management is about protecting your property before the problem becomes messy.

Itโ€™s not just about collecting rent and sending out notices.

Itโ€™s about spotting issues early, taking the right action, keeping you informed, and making sure everything is handled properly when things donโ€™t go to plan.

One of our recent properties has just been leased above the asking price!!

But the result didnโ€™t happen by chance.

Before launching the property, I spent time researching the market, looking at competing properties, current rental demand, pricing and what tenants were actually responding to.

Then came the preparation.

It wasnโ€™t just about making the property physically presentable. I looked at the overall presentation and positioning : how we could make the property stand out online and create the right first impression from the moment a tenant saw it.

And it worked.

Within the first week, we had strong enquiry, plenty of people through the open home and genuine competition between prospective tenants.

That competition is what ultimately gave us the confidence to secure a great result for the owner - around the asking price, without needing to compromise.

This is why I donโ€™t believe property management is simply about putting a property online and waiting for someone to apply.

Saw this in a landlord group and it's such a common crossroads, so I wanted to share my take.

Quick fact first: in NSW, you can increase rent during a fixed-term lease - even a 2 year one, as long as the lease is 12 months or longer and there's a clause allowing it. So the "but what if I'm locked in for 2 years" fear isn't actually a dealbreaker.

Here's how I'd think about this specific situation:

If the tenants are good tenants who are pay on time, look after the place, easy to deal with and you're not planning to sell or renovate any time soon, I'd take the 2 year lease. Here's why:

You get some sort of commitment from the tenant that at the time of signing they are commiting a 2 years lease, avoiding you signing a new lease after 12 months.

You still get to review the rent along the way, so you're not stuck at today's number for 24 months.
And you're rewarding a good tenant for wanting to commit which, honestly, is the tenant you want to keep.

The market crash question is fair, but a 2 year lease doesn't stop you from selling - it just means the sale happens with a tenant (and income) in place, which a lot of investors actually prefer.

I say this once and I will say it again:

The property manager you picked because they were "nice" on the phone? That's not a qualification.

I get it. You're handing over one of your biggest assets to a stranger, and it feels good when someone's warm and easy to talk to. But warm doesn't stop a bad tenant getting through. Warm doesn't chase a late rent payment on day one instead of day fourteen. Warm doesn't call you back when something actually goes wrong.
