408 Pandemic Visa is closing to new applicants from 2 September 2023.

Existing 408 pandemic visa applicants can make further applications but will also be closed from February 2024.

From 2 September 2023, new applications will receive a six month visa. A Visa Application Charge of $405 AUD will also be introduced.

Thus, anyone who can apply now should apply straight away and before end of the day 1 September 2023

Significant reduction in State Sponsorship numbers for the 23-24 financial year.

Both ACT and Tasmania governments have published their 491/190 quota for the current financial year, both are receiving 600 allocations for each of the 491 and 190 visa categories.

Though there are high number of budget allocation of visa grant, these number are reserved for visa already being lodged and are in the pipelines waiting for processing.

Further there are no allocation for 188 business visas as the government is still reviewing the program.

We do expect due to limited allocation numbers the program will be competitive between applicants.

The department has annouced that there is no minimum income requirement for the Permanent Residence (Skilled Regional) visa (subclass 191).

Primary applicants must provide notices of assessment issued by the Australian Taxation Office (ATO) for three income years out of the five years of their eligible visa. Primary applicants who have already lodged should ensure their application provides these three notices.

TSMIT increase will only apply from 1 July 2023 and does not effect applications lodged prior. Temporary Skilled Migration Income Threshold will be raised to $70,000.

ALL OCCUPATIONS will be eligible to apply for 186 TRT by the end of 2023. TRT Eligibility will be shortened to 2 years from current 3 years.

Direct Australian citizenship for NZ citizens

Minister O'Neil's announced on Saturday that NZ citizens will be eligible for direct Australian citizenship. ​

From 1 July 2023, New Zealand citizens who have been living in Australia for four years or more will be eligible to apply directly for Australian citizenship. They will no longer need to first apply for and be granted a permanent visa. These changes apply to New Zealand citizens holding a Special Category (subclass 444) visa (SCV) who arrived in Australia after 26 February 2001. Protected SCV holders will continue to be eligible to apply directly for Australian citizenship.

For New Zealand citizens who are long-term residents in Australia, this will be achieved by backdating their period of permanent residence for citizenship purposes. This will allow them to meet the 12-month permanent residence period under the general residence requirement.

The general residence requirement for Australian citizenship by conferral is set out in the Australian Citizenship Act 2007. To meet the general residence requirement an applicant must be lawfully present in Australia for four years, including 12 months as a permanent resident, immediately before the date of application.

With effect from 1 July 2023:

- All New Zealand citizens holding an SCV will be considered permanent residents for citizenship purposes.

- New Zealand citizens granted an SCV before 1 July 2022 will have their period of permanent residence for citizenship purposes backdated to 1 July 2022.

- New Zealand citizens granted an SCV for the first time on or after 1 July 2022 will be considered a permanent resident for citizenship purposes from the date of their SCV grant.

The above provisions will apply to New Zealand citizens in Australia. It will also apply to New Zealand citizens who are overseas, but held an SCV immediately before last leaving Australia.

These provisions will not apply to citizenship applications submitted before 1 July 2023. If you submit your citizenship application before this date, and you do not meet the eligibility requirements, we will refuse your application and you will not be entitled to a refund.

The backdating of permanent residence for SCV holders will also impact children born to SCV holders. From 1 July 2023, any child born in Australia on or after 1 July 2022 to an SCV holder may automatically acquire Australian citizenship at birth. From 1 July 2023, children who meet these circumstances can apply for​ evidence of citizenship.

Student visa work right limit to be increased to 48 hours per fortnight from 40 from 1 July 2023.

The 485 Post-Study Work visa to be increased for a further 2 years with SELECT qualifications from 1 July 2023.

Bachelor from 2 to 4
Master from 3 to 5
Doctorate from 4 to 6

Many occupations in Medical and Nursing, Professional Health, Diagnostic and Allied Health, Teaching, Engineering, ICT and Agricultural have been flagged to be included in the eligible occupation list.

A comprehensive list of qualifications mapped to CRICOS will be published.

Eligible graduates with a valid Temporary Graduate Visa on 1 July 2023 or who apply for a Temporary Graduate Visa after 1 July 2023, will be considered for the two year extension.

Graduates whose visa expires before 1 July 2023 can apply for an extension of their work rights by visiting Temporary Activity visa (subclass 408) Australian Government endorsed events (COVID-19 Pandemic event).

New Regional NSW-based direct pathway - for applicant who has lived and worked in regional NSW for at least 12 months

To apply under this pathway, you must:

- Ensure you are eligible for this visa subclass

- Be currently living and working in their nominated (or closely related) occupation in a designated regional area of NSW, and have continuously done so for the past twelve (12) months for a minimum of 20 hours per week

- Have a valid skills assessment in an occupation within a unit group that appears on the NSW Regional Skills List and is eligible for the visa

- Are paid at least the TSMIT level or $53,900 per annum (full time basis) excluding superannuation

- Provide evidence for all points claims in your SkillSelect EOI, and where you currently reside, with your application. You must also provide a copy of your SkillSelect EOI

NSW government announced changes to the 190/491 sponsorship criteria for the current financial year. NSW skills occupation list is yet to be released.

Skilled Nominated Visa (Subclass 190)

NSW nomination for the Skilled Nominated visa (subclass 190) remains by invitation only.

As with previous years, because demand for NSW nomination greatly exceeds the number of available places, we strongly recommend you explore all other migration pathways and do not wait to be invited by NSW.

Key changes to NSW nomination this financial year include:

Your SkillSelect EOI

Your SkillSelect EOI must be for the Skilled Nominated visa (subclass 190) and NSW only. EOIs selecting additional visa subclasses and/or other Australian states or territories will be excluded from consideration.

Note: When your SkillSelect EOI was created or amended in no way affects your likelihood of being invited to apply for NSW nomination.

Residency Requirement

To be eligible for NSW you must be either currently residing in NSW or offshore, and have done so for a minimum period of six months.

Offshore Candidates

Offshore candidates will be considered in all occupations within unit groups identified on the NSW Skilled Nominated Skills List that are eligible for the Skilled Nominated visa (subclass 190). This means there are no excluded unit groups this financial year.

Minimum Experience and Scores

Each unit group will have a minimum number of years of skilled work experience and minimum point score to be eligible for NSW nomination. These minimum numbers will be identified on the NSW Skilled Nominated Skills List.

Minimum numbers are informed by the number of places available in each unit group for the financial year and the number of EOIs submitted in SkillSelect.

If you score below these numbers, unfortunately you are not eligible for NSW nomination.

Skilled Work Regional Visa (Subclass 491)

There will be two pathways to NSW nomination for the Skilled Work Regional visa (subclass 491) this financial year. Eligibility
criteria applies equally to both pathways.

Pathway 1

Apply directly to an RDA office in the region that you wish to live and work in for a minimum period of three years after being granted your visa by Home Affairs.

If you meet the minimum eligibility requirements for NSW nomination, you may apply to an RDA office at any time throughout the financial year until that region has exhausted its allocation of places.

Pathway 2

Be invited to apply by Investment NSW. Invitation rounds will occur ongoing throughout the financial year. There will be no set date. If you are invited by Investment NSW, you may live and work in any designated regional area of NSW for a minimum period of three years after being granted your visa by Home Affairs.

Key changes to eligibility criteria this financial year include:

You are exempt from the minimum work experience requirement under Pathway 1 (only) if you have completed study in regional NSW within the most recent 24 months before applying to an RDA office; AND your study is related to your nominated (or closely related) occupation; AND your study in regional NSW makes you eligible to claim points for Study in regional Australia.
