Rohan de Meryick and Grant Watson discussing the important medical negligence case of Hobson v Sparks and sections 5O & 5I of the Civil Liability Act 2002 (NSW). If we look happy, it was because it was also a great win for our client.

Great win for our client, who suffered paraplegia as a result of the negligent failure to halt a surgical procedure, with the High Court declining to grant special leave to appeal the earlier decision of the NSW Court of Appeal in Sparks v Hobson, which upheld his award of $3.8 million plus costs.

Interesting questions left to be addressed regarding section 5O of the Civil Liability Act 2002 following this case and the earlier decision in McKenna v Hunter & New England LHD. I will write about these soon - GW

(1)   Dismiss Dr Sparks’ appeal with costs; (2)   Allow Dr Gray’s appeal; (3)   Set aside orders 1 and 2 made at first instance so far as they relate to Dr Gray; (4)   Judgment for Dr Gray on the respondent’s claim against him. (5)   Order the respondent to pay Dr Gray’s costs...
