Successful Partner Visa Appeal at the ART 🎉🎊

Our client approached us after their permanent partner visa application had been refused because the required Australian Federal Police certificate had not been provided.

We lodged an appeal with the Administrative Review Tribunal, provided the police certificate, prepared written submissions and requested expedited consideration.

The Tribunal set aside the refusal decision and remitted the visa application to the Department for reconsideration. The Tribunal review was finalised in approximately six weeks.

This outcome highlights the importance of obtaining legal advice promptly after a visa refusal and carefully responding to all requests from the Department.

Successful Partner Visa Appeal 🎉

The Administrative Review Tribunal set aside the refusal of our client’s Partner visa (Subclass 820) application.

The visa had originally been refused because the applicant provided incorrect information in an earlier visa application, including failing to disclose a former legal name and previous visas to Australia.

The Tribunal accepted there were compassionate and compelling circumstances in this matter.

PIC 4020 was waived and the application was returned to the Department for reconsideration.

A great outcome for our client and their family.

Another great result at the Administrative Review Tribunal.

Our client’s Subclass 602 Medical Treatment visa had been refused on the basis that the Department was not satisfied she genuinely intended to stay temporarily in Australia.

After presenting detailed evidence, the Tribunal accepted that our client genuinely intended to remain in Australia only for the completion of her medical treatment and rehabilitation. The Tribunal set aside the refusal decision and remitted the matter to the Department for reconsideration.

A positive outcome for a client who had been undergoing ongoing medical treatment and recovery following a serious injury.

✅ Successful ART outcome for a Subclass 482 visa applicant involving complex PIC 4020 issues for not disclosing offences. The Tribunal set aside the refusal decision and remitted the matter back to the Department for reconsideration 🇮🇪

✅ Medical Treatment (Subclass 602) visa granted for a client who had a visa cancelled. This outcome allows the client to remain lawfully in Australia and continue receiving necessary treatment and support 🇮🇪

✅ Successful waiver of a “No Further Stay” condition for our client from Lebanon, allowing them to pursue further visa options onshore following significant changes in circumstances and ongoing instability affecting the region 🇱🇧

We are pleased to announce a successful Ministerial Intervention outcome for two of our clients.

The Assistant Minister for Immigration considered the request and exercised discretion to substitute the Tribunal decision with a more favourable outcome, resulting in the grant of a Visitor (Substituted subclass 600) visa.

The Administrative Review Tribunal has set aside the cancellation of our client’s Subclass 858 (Global Talent) visa and substituted a decision not to cancel it.

🟢 The visa was originally cancelled under s 109(1) of the Migration Act 1958 (Cth) on the basis of an alleged breach of s 103 – bogus document.

🟢 However, the Tribunal, after considering the evidence and the prescribed circumstances made a decision in their favour.

The Administrative Review Tribunal has remitted our clients application for a Subclass 500 (Student) visa for reconsideration — with a key determination:

✅ The applicant meets Public Interest Criterion 4013 under clause 500.217 of Schedule 2 to the Migration Regulations.

📌 What is PIC 4013?
PIC 4013 applies to people whose visas have been refused or cancelled on certain grounds. It usually prevents them from being granted a further visa — unless a waiver is granted.

How do you get it waived?
A waiver can be approved if you can demonstrate:

✅Compelling circumstances affecting Australia's interests, or

✅ Compelling and compassionate circumstances impacting an Australian citizen, permanent resident, or eligible NZ citizen.
