Divorce and separation are complex issues that can have significant emotional, and legal ramifications.

The Family Law Act 1975 (Cth) and the Succession Act both serve as important legislation when it comes what happens to a person’s will after marriage.

The provisions under the Succession Act are only valid if the relationship is terminated by divorce.

It is important that once marriage occurs, both spouses should effectively presume their previous wills prior to marriage to be revoked, and seek advice in drafting up a fresh will.

Are you considering buying an off-the-plan property? 🏠💰Make sure you know your rights and do your due diligence before signing on the dotted line. Here are some things to keep in mind:

• Pay attention to the documents attached to the contract for sale of land and your rights before purchasing Off the Plan properties.

• Don't just look at the architectural plans; compare them with the draft strata plan to ensure you're getting the space you expect.

• Keep in mind that the dwelling you receive may not be exactly the same size as in the drawings due to minor variations by developers or builders.

• Section 66ZS of the Conveyancing Act in New South Wales provides additional protections for purchasers of off-the-plan properties by requiring developers to give notice of changes to the contract, allowing purchasers to rescind the contract if material changes are made without notice.

And don't forget about the sunset date! This is the date by which the construction of the property must be completed. If the sunset date is extended, it may cause delays in the settlement process and potentially impact the value of the property. So make sure you understand your rights and restrictions on parties being able to escape the contract and the impact of not having access to your deposit monies for an extended period of time.

If you're considering an off-the-plan purchase, take the time to do your research and make an informed decision.

👨‍💼👩‍💼🧑‍💼Our property lawyers can assist you along the way with off-the-plan purchases. ☎️ Contact our office today to book an initial consultation 💯
