NSW is not accepting any further applications for 491 state nomination under Pathway 1 as they have filled their allocation of places for Pathway 1. Applications that have already been submitted will be processed.

NSW has commenced issuing invitations for the 491 visa- Pathway 2. The first round of invitations was issued yesterday, and new invitation rounds will occur every 4 weeks until the allocation is filled.

โ€ข Queensland have nominated 465 applicants out of their 1200 state nomination places, so they have filled approximately 39% of their quota.

โ€ข Queensland previously required at least Proficient English for 190/491 state nomination but this has now been reduced to at least Competent English for all occupations. Queensland's website will be updated shortly to reflect their new English requirement.

โ€ข There is no set schedule for invitation rounds this program year, and invitation rounds will be conducted as needed.

โ€ข The next invitation round will be for offshore workers, and invitations for offshore candidates will commence in the coming weeks.

โ€ข Queensland still has places available in a range of sectors and occupations including trade occupations, teachers, agriculture, energy workers, healthcare including specialist medical practitioners and other professionals.

The Australian Government has released a new occupation list, known as the Core Skills Occupation List (CSOL). This occupation list will be associated with the new Skills in Demand visa which will replace the TSS visa (subclass 482).

The new Skills in Demand visa will be introduced on 7 December 2024.

The CSOL will apply to the Core Skills stream of the Skills in Demand visa, along with the 186 visa- Direct Entry stream.

NSW has opened its state nomination program for the 2024-2025 program year.

NSW's priority sectors are:

โ€ข Construction (infrastructure and housing);
โ€ข Renewables (net zero and clean energy);
โ€ข Care economy (aged care and disability services, early childhood education and care sectors);
โ€ข Digital and cyber (across all sectors);
โ€ข Education (teachers);
โ€ข Agricultural and Agrifood; and
โ€ข Advanced Manufacturing.

NSW will commence their invitation rounds for NSW 190 state nomination shortly.

The Migrant Justice Institute have launched an important national survey to improve working conditions for migrants and international students in Australia, and prevent modern slavery.

The survey also provides migrants with important information about their rights at work and referrals to support services.

The surveys shift the dial on migrant worker issues in Australia.

Previous surveys led to new world-first visa protections for exploited migrants who take action to enforce their rights at work, and new migrant legal services.

This survey's findings will drive the next 5 years of change.

There are $10,000 of prizes up for grabs (50 x $200 Mastercard vouchers).

The survey is funded through the Commonwealth Attorney Generalโ€™s Departmentโ€™s Modern Slavery National Action Plan.

The online survey is anonymous, takes 10-15 minutes, and is available in Mandarin, Nepali, Spanish, Arabic and Tamil.

The survey is open to anyone who has worked in Australia on a temporary visa (or undocumented) since 2009.

The survey closes 31 August 2024.

NSW has exhausted its 190/491 allocation for the program year 2023-2024.

โ€ข Any applications that remain on-hand will be finalised in the 2024-2025 program year.

โ€ข Applications for 491 nomination for Pathway 1 are now closed.

โ€ข NSW is currently working on updating its nomination criteria for Pathway 1 for the 2024-2025 program year and will release the relevant details in due course.

Tasmania's state nomination program for 2023-2024 is now closed to new Registrations of Interest (ROI).

โ€ข Tasmania will not be issuing any further invitations to apply for state nomination this program year.

โ€ข Tasmania will continue to assess state nomination applications that have been lodged but not yet decided. However, as only a few nomination places are remaining, not all applicants will be nominated this program year.

โ€ข Once Tasmania uses up its remaining places, any state nomination applications that are approved will be nominated against Tasmania's new nomination allocation for the 2024-2025 program year.

The Department has announced that the TSMIT will increase from $70,000 to $73,150 on 1 July 2024.

New nominations lodged on or after 1 July 2024 will need to meet the new TSMIT or the annual market salary rate, whichever is higher. However, if the annual market salary is less than TSMIT, a nomination application cannot be lodged for that position.

This change does not impact on existing visa holders and nominations lodged prior to 1 July 2024.

If you have an employer-sponsored application currently being prepared and are concerned you may be impacted by the change in TSMIT, please speak to your immigration lawyer or registered migration agent on retainer for the application for further guidance.

The Australian Government has announced that they will maintain the age limit for the 485 visa- post study work stream at under 50 for Masters by research and PhD graduates after 1 July 2024.

This stream will be renamed to the Post-Higher Education Work stream on 1 July 2024.

Hong Kong and BNO passport holders will still be eligible if they are under 50 years of age.

For other applicants, the age limit will reduce to 35 years of age or under at the time of lodgement.

Victoria has announced that their state nomination program will close to new Registrations of Interest (ROI) at 5pm AEST on Tuesday, 23 April 2024.

For the 2023-2024 program year, the Australian Government allocated to Victoria 3,300 skilled visa places, comprising of 2,700 places for the 190 visa and 600 places for the 491 visa.

Victoria has indicated that they have used up 3,200 of these nominations, and they will continue to assess submitted ROIs for any remaining nomination places for this program year.
