Owing $100,000 or more to the ATO?

You are not alone.

Many business owners and individuals fall behind because of cash flow pressure, overdue BAS, PAYG, income tax debt, unpaid superannuation, payment plan defaults, or interest and penalties that keep building.

But once ATO debt reaches this level, it should not be ignored.

Issues may include:

• ATO payment demands
• ongoing interest and penalties
• payment plan pressure or default
• overdue lodgements
• garnishee warnings
• Director Penalty Notice risk
• business cash flow pressure
• refinancing or credit issues

In some cases, options may still be available.

That may include negotiating with the ATO, reviewing payment arrangement options, dealing with outstanding lodgements, assessing director risk, considering restructuring options, or applying for remission or reduction of interest and penalties where appropriate.

The key is to act before the matter becomes urgent.

Tax Legal Solutions helps business owners, directors and individuals understand their options before ATO debt or tax pressure escalates.

Family trusts are now firmly in the spotlight.

The 2026 Budget proposed a 30% minimum tax on discretionary trusts from 1 July 2028, with some exceptions.

That does not mean every family trust needs to be changed immediately.

It also does not mean every trust is affected in the same way.

But it does mean that people using discretionary trusts should understand their position before making decisions about income distributions, business structures, property, investments, asset sales or restructuring.

You may need to review your position if you:

• run a business through a family trust
• own investment property through a trust
• distribute income to family members
• hold shares, property or other assets in a trust
• use a corporate beneficiary
• are considering selling assets
• are thinking about restructuring before future start dates
• are unsure whether the Budget changes affect your structure

The mistake is waiting until a deadline is close, or making changes based only on headlines.

Your actual position may depend on the trust deed, beneficiaries, assets, income, distributions, tax history, business structure and future plans.

Tax Legal Solutions helps business owners, property investors, directors and trust users understand whether their structure needs proper review before they act.

Budget headlines are one thing. Knowing what actually applies to you is another.
There has been a lot of noise about the 2026 Budget tax changes, including capital gains tax, negative gearing, family trusts and even collectables.
But not every change starts immediately.
Some changes are proposed to start later.
Some may only affect certain people.
Some may depend on what you own, when you bought it, how it is structured and whether you are planning to sell, refinance or restructure.
This is why people should be careful about making decisions based only on headlines.
You may need to review your position if you:
• own investment property
• are planning to buy or sell property
• use a family trust or discretionary trust
• hold shares, collectables or investment assets
• run a business through a trust structure
• have ATO debt or tax pressure
• are considering refinancing or restructuring
• are unsure whether the Budget changes affect you
The issue is not just “what changed?”
The better question is:
Does this actually affect my situation, and do I need to act before a future start date?
Tax Legal Solutions helps individuals, business owners, directors, property investors and trust users understand whether their position needs proper review before they make important decisions.

The “47% Pokémon card tax” headlines are getting attention — but the real issue is bigger than Pokémon cards.

The 2026 Budget tax changes have created confusion around capital gains tax, negative gearing, discretionary trusts, property, collectables and investment assets.

Some changes have not started yet.

Some are proposed to begin from 1 July 2027.

Some trust changes are proposed to begin from 1 July 2028.

But people are already asking the right question:

“Does this affect me?”

That may depend on whether you:

• own investment property
• are planning to buy or sell property
• use a family trust or discretionary trust
• hold shares, collectables or other investment assets
• run a business through a trust structure
• have ATO debt or tax pressure
• are considering refinancing, restructuring or selling assets

The mistake is making decisions based only on headlines.

A headline about Pokémon cards might get attention, but your actual tax position depends on your structure, assets, timing and personal circumstances.

Tax Legal Solutions helps individuals, business owners, directors, property investors and trust users understand whether their position needs proper review before they act.

New financial year. Same ATO debt.

For many business owners and individuals, 1 July does not wipe away old tax problems.

If you entered the new financial year with ATO debt, overdue BAS, unpaid PAYG, unpaid superannuation, payment plan pressure, interest, penalties or cash flow issues, it is worth reviewing the position before it escalates.

ATO debt can become harder to deal with when there are:

• missed payment plans
• ongoing General Interest Charge
• penalties continuing to build
• overdue lodgements
• ATO payment demands
• garnishee warnings
• Director Penalty Notice risk
• refinancing or credit pressure

In some cases, options may still be available.

That may include negotiating with the ATO, reviewing payment arrangement options, dealing with outstanding lodgements, assessing director risk, considering restructuring options, or applying for remission or reduction of interest and penalties where appropriate.

The key is to act before the matter becomes urgent.

1 July is here — and the new financial year has started.

For business owners, this is not just an accounting date.

From 1 July 2026, several changes may affect business cash flow, payroll, superannuation and tax planning, including:

• Payday Super
• closure of the ATO Small Business Superannuation Clearing House
• minimum wage and award wage increases
• the permanent $20,000 instant asset write-off for eligible small businesses
• ongoing ATO payment, BAS, PAYG and superannuation obligations

If your business is already dealing with ATO debt, overdue BAS, unpaid super, PAYG issues, payment plan pressure, tax arrears, refinancing pressure or cash flow problems, now is the time to review the position.

Waiting until there is a default, penalty, garnishee notice, director penalty notice or ATO escalation can make the situation harder to manage.

Business owners: 1 July is not just the start of a new financial year.

It is also when a number of business, payroll, wage and superannuation changes begin.

For businesses already dealing with cash flow pressure, ATO debt, overdue BAS, unpaid superannuation, refinancing issues or tax arrears, this is a good time to review the position before it becomes urgent.

Key issues to check include:

• ATO payment arrangements
• overdue BAS, PAYG or income tax
• unpaid or late superannuation
• payroll and wage obligations
• director penalty notice risk
• business cash flow pressure
• refinancing or credit issues
• whether restructuring options should be considered

The earlier these issues are reviewed, the more options may be available.

If your business has ATO debt, tax arrears, unpaid superannuation or cash flow pressure, Tax Legal Solutions can help you understand your options before the matter escalates.

End of financial year is not just about lodging a tax return.

For many business owners, directors, property investors and individuals, this is the time to check whether anything needs to be dealt with before 30 June or before new changes begin from 1 July.

This may include:

• ATO debt or payment arrangements
• outstanding BAS, PAYG or tax lodgements
• unpaid or late superannuation
• business cash flow pressure
• asset purchases and deductions
• company or director obligations
• refinancing or credit pressure
• property, trust or investment decisions
• proposed Budget changes affecting negative gearing, CGT or family trusts

The mistake is waiting until there is a default, penalty, ATO escalation, finance issue or urgent deadline before getting advice.

If you are unsure whether your tax, business, property or ATO position needs review before the end of financial year, you can contact Tax Legal Solutions for a free confidential initial call.
