Experiencing family violence while on a temporary Partner visa in Australia does not mean you have to stay in an abusive relationship to remain in the country. Australia has provisions in its migration laws to protect individuals in such situations. If you hold a temporary Partner visa (subclass 309 or 820) or a Prospective Marriage visa (subclass 300) and your relationship has ended due to family violence, you may still continue with your permanent Partner visa (subclass 100 or 801) application.

The Department of Home Affairs requires evidence to support your claims of family violence, which can be judicial (such as court orders) or non-judicial (such as statutory declarations and reports from medical professionals, police, or social workers). It's crucial to gather and present this evidence carefully to ensure your case is strong​.

If however you are offshore and your Subclass 309 has not been granted, it will not be granted even if you can establish a claim of domestic violence.

Planning for the next subclass 189 invitation round?

The Department of Home Affairs has advised that the next Skilled Independent visa subclass 189 invitation round is expected to be held by 30 September 2026.

If you have an active Expression of Interest in SkillSelect, now is the time to review it carefully.

Do not wait until the last minute.

Before the next round, check:

Your current points score
Your skills assessment validity
Your English test validity
Your work experience claims
Your partner points
Your occupation details
Your passport and personal information
Your EOI date of effect and accuracy

Remember, your EOI must reflect your current and correct information. Incorrect claims can create serious issues later, even if you receive an invitation.

This is also the right time to assess where you stand against the competition.

Are your points strong enough for your occupation?
Is your English score helping or limiting your chances?
Is your skills assessment still valid?
Should you consider 190, 491 or employer sponsorship as a backup pathway?

A 189 invitation is competitive. The applicants who prepare early are usually in a better position when the round comes.

Have you applied for a Student visa offshore while holding a 485 visa, and received a quick refusal?

VETASSESS has announced that fees for Professional Skills Assessments will increase from 9 September 2026 in line with inflation.

This change will apply to Professional Skills Assessment applications, Priority Processing, Skills Assessment Support, Chinese Qualification Verification, Non-migration Skills Assessments and administration fees.

The fee increase does not apply to trade occupation assessments.

If you are planning to apply for a VETASSESS skills assessment, applications received before 9 September 2026 will still be charged at the current rates. This may be an important time to review your occupation, documents, employment evidence and eligibility before the new fees take effect.

A skills assessment is a key step for many skilled migration pathways, including subclass 189, 190 and 491 visas. Preparing the application properly can help avoid delays, document issues or unnecessary costs.
