Thinking of bringing your partner to Australia on a Visitor visa and applying for a Partner visa later?

⚠️ Things are changing.

The Australian Government has recently announced that "No Further Stay" conditions will be introduced on future Visitor visas. This can have a significant impact on people who hope to apply for another visa while in Australia.

If your Visitor visa has condition 8503 – No Further Stay, you may be prevented from applying for most other substantive visas while in Australia unless the condition is waived.

💡 The important point:
Don't assume that being married to, or in a genuine relationship with, an Australian citizen or permanent resident automatically allows you to apply for a Partner visa onshore.

Your visa conditions, immigration history and individual circumstances all matter.

❓ 1. Can I apply for a Partner Visa while on a Working Holiday Visa?

✅ Yes – if you’re in a genuine relationship with an Australian citizen, permanent resident, or eligible NZ citizen, you can apply for an onshore Partner Visa (Subclass 820/801). Just make sure you lodge your application before your current visa expires and that you don’t have a “no further stay” condition.

❓ 2. Do I get a Bridging Visa after I apply?

✅ Yes – when you lodge a valid onshore partner visa application while holding a substantive visa, you are automatically granted a Bridging Visa. This kicks in once your working holiday visa expires, keeping you lawfully in Australia while your application is processed.

❓Planning to move from a Visitor Visa (SC600) to a Partner Visa (SC820/801)?

Avoid these common mistakes 👇

Many couples don’t realise that a Visitor Visa is for short-term stays only and does not support long-term migration plans. Before applying for an onshore Partner Visa, here are key things to watch out for:

⚠️ No Further Stay (8503)– This condition may stop you from applying for another visa in Australia unless a waiver is granted.

❤️ Relationship Evidence – You must prove a genuine and ongoing relationship (generally 12 months). Marriage, registered relationships, shared finances and living arrangements matter.

🚫 Incorrect Information – Inconsistent details between visa applications can lead to refusal under PIC 4020.

⏳ Timing Matters – Apply before the Visitor Visa expires to avoid becoming unlawful. A Bridging Visa may be granted after a valid application.

👤 Sponsor Eligibility – Past sponsorships or criminal history may affect approval.

🩺 Health & Character Checks – Medical exams and police clearances are required.
