⚠️ Has your SMSF changed recently? A simple update could trigger important reporting obligations.

If you've changed a trustee, member, corporate trustee director, fund address, or contact details, you generally need to notify the ATO within 28 days. If your SMSF has a corporate trustee, you may also need to lodge ASIC Form 484—updating one regulator does not update the other.

Missing these deadlines can lead to unnecessary compliance issues and penalties.

Did you know your SMSF may be able to invest 100% in a related unit trust without breaching the 5% in-house asset limit?

The key is complying with Regulation 13.22C.

To qualify:
✔️ The trust must be a genuine unit trust
✔️ No borrowing allowed
✔️ No mortgages or charges over assets
✔️ No business activities
✔️ No investments in other entities
✔️ Related-party leases only for business real property on market terms

But there is a major warning: under Regulation 13.22D, a single breach can permanently taint the structure and cause serious SMSF compliance issues.

Most SMSF trustees think their BDBN is locked in.

It’s not.

In many cases, it silently expires every 3 years—depending on the trust deed.

That means:
âť— No valid nomination
âť— Trustee discretion applies
âť— Benefits may not go where intended

The High Court (Hill v Zuda) made it clear—
BDBNs don’t have to lapse… but only if the deed allows it.

The real risk?
Many deeds still enforce lapsing rules.
