When a Visa Refusal Isn’t the End of the Road

One of our recent success stories involved a baker whose visa application had been refused.

After carefully reviewing the refusal, the first question wasn’t simply “Can we win an appeal?” but rather “What is the best strategy for the client?”

At Solve Migration, every refusal is assessed on its own merits. Sometimes an appeal to the Administrative Review Tribunal is the best option. Other times, a fresh application may provide a faster or more cost-effective pathway.

In this case, Cindy Lam conducted a detailed assessment of the refusal reasons, the available evidence, the client’s immigration history, and the risks associated with each option. We ultimately recommended a new application rather than pursuing a lengthy appeal process.

The result? The client was granted their visa and can now continue building their future in Australia.

Many people assume that lodging a new application is always easier than appealing. Unfortunately, that’s not always true. A new application can carry significant risks, including:
• Loss of work rights or study rights
• Bridging visa complications
• Triggering Schedule 3 issues
• Missing critical application deadlines
• Becoming unlawful
• Losing review rights altogether

Likewise, an appeal is not always the right answer simply because it is available.

The key is understanding both the legal merits and the practical visa consequences before making a decision.

We are pleased to share another successful outcome for one of our clients at the Administrative Review Tribunal (ART).

Our client, a skilled Tiler employed by a waterproofing business, faced a visa refusal that placed both his future in Australia and his employer’s workforce plans at risk.
