We are hiring.

For most of our clients, their first contact with The Estate Planning Centre is either a well-answered phone call or a warm welcome at the door. We are looking for the right person to be both.

Someone organised and proactive, who takes genuine pride in looking after our clients from that very first moment, and who enjoys keeping a busy practice running smoothly.

It is a permanent, full-time role in our Sydney CBD office, close to Martin Place. Full training is provided, so previous legal experience is not required - an interest in learning about the field is a great asset.

If AI can edit your emails, put together your shopping list, and summarise your Zoom meetings, surely it can write your Will… right?

The blunt answer is yes, technically, AI can write your Will. The better question to ask is, “Should AI write your Will?” And our answer to that question is just as blunt.

❌ No, AI should NOT write your Will.

AI can offer a starting point, but it can’t go beyond the basics. And with AI hallucination still a major burden on the technology, AI simply can’t be trusted to keep up with changing succession laws.

Here are our three reasons why you shouldn’t use AI to write your Will:

1️⃣ AI can’t detect nuance, which is crucial when working with families and understanding their dynamics in order to create an estate plan that works from every angle, in every possible scenario.

2️⃣ AI can’t structure testamentary trusts properly for tax effectiveness. It can perhaps explain what a testamentary trust is, but it doesn’t understand how these concepts work together.

Simply put, AI doesn’t know what it doesn’t know.

3️⃣ AI can’t ensure that your Will has been correctly signed and witnessed in order to be legally binding.

And if it turns out this hasn’t been done correctly and your Will is challenged or declared invalid, AI can’t represent you in court. We can. ✅

Putting together an estate plan goes much further than compiling a document. It’s about planning for the future, from every possible angle. It’s about asking questions and exploring all avenues for asset protection.

🚨 BREAKING: A very welcome outcome for Australian families.

The Federal Government has confirmed that income from genuine testamentary trusts will be exempt from the proposed 30% minimum tax announced in the 2026 Federal Budget.

This is encouraging news and recognition of the important role testamentary trusts play in protecting Australian families.

But testamentary trusts have never been just about tax. Done well, they can help protect inheritances from:

✔️ Relationship breakdowns
✔️ Premature access to wealth
✔️ Bankruptcy and creditor claims
✔️ Addiction, disability and other vulnerabilities
✔️ Assets passing outside the bloodline unintentionally

Importantly, the Government has also reaffirmed that Australia has no inheritance tax or death duties.

However, some aspects of the announcement still warrant careful consideration.

From 1 July 2028, the proposed exclusion is limited to discretionary testamentary trusts that can only benefit individuals and income tax exempt entities.

The detail matters.

We remain hopeful that the Government will engage in genuine consultation with the profession and the community before these measures are finalised.

At The Estate Planning Centre, we will continue to advocate for a complete exclusion for genuine testamentary trusts. If Australia truly has no inheritance tax or death duties, that principle should be preserved in substance, not merely in name. Measures that impose additional tax simply because wealth passes on death risk becoming a death tax by another name.

Estate planning is about more than tax. It is about protecting loved ones, preserving options and stewarding wealth wisely across generations.
