🚨 TRANCHE 2 AML/CTF REFORMS ARE COMING – ARE YOU READY? 🚨

From 1 July 2026, Australia's AML/CTF regime will expand to cover lawyers, conveyancers, accountants, trust and company service providers, real estate professionals and certain dealers in high-value goods.

For many clients, this will mean additional identity verification and due diligence requirements when engaging professional advisors.

📌 What legal services are captured?

Law firms will be required to comply with AML/CTF obligations when providing certain designated services, including:

🏠 Property Transactions

• Buying and selling real property
• Conveyancing matters
• Assisting with property settlements

🏢 Companies & Business Structures

• Incorporating companies
• Selling or transferring companies
• Assisting with business acquisitions and disposals
• Acting in relation to company structures and ownership arrangements

🤝 Trusts & Other Legal Arrangements

• Establishing trusts
• Acting as trustee arrangements
• Assisting with trust structures and administration

💼 Corporate & Commercial Transactions

• Managing client funds in connection with certain transactions
• Assisting with mergers, acquisitions and restructures

🚨🚨ATTENTION PROPERTY INVESTORS & PURCHASERS🚨🚨

Federal Government set to impose 2-year ban on purchases of 'established dwellings' by "Foreign Persons" such as temporary residents and foreign owned companies from 1 April 2025!

👉🏼 From 1 April 2025 to 31 March 2027, foreign purchasers/investors banned from buying existing dwellings in Australia.

👉🏼 The ban will not affect permanent residents, New Zealand citizens or spouses of Australian citizens.

👉🏼 Other limited exceptions may apply.

🚨🚨ATTENTION PROPERTY BUYERS & SELLERS🚨🚨

Changes to the Foreign Resident Capital Gains Withholding (FRCGW) regime to commence 1 January 2025!

👉🏼 Applies to all Contracts for the Sale & Purchase of Land entered on or after 1 January 2025;

👉🏼 Withholding rate increased to 15% of the sale price;

👉🏼 $750,000 threshold SCRAPPED!

❓What does all this mean?? All Australian residents selling property will require a clearance certificate from the ATO, or withholding tax of 15% of the sale price will apply to the transaction. This amount must be withheld by the purchaser and paid to the ATO.
