Kids and other vulnerable beneficiaries can't manage inherited wealth alone. That's why testamentary discretionary trusts exist.

They're used so parents can ensure their children will be able to properly be fed, clothed and educated if they should die before their children finish school, and so the funds will be ringfenced from any potential bad actors who may try to prey on their circumstances.

In addition, a surviving partner or new guardian will often need extra support to continue to work and care for the family left behind. This is often a significant unexpected expense which is often alleviated by the current tax treatment of testamentary discretionary trusts.

Taxing all that at 30% doesn't close a loophole. It closes the safety net.

FEDERAL BUDGET ANNOUNCEMENT AND TDTs

There’s been a lot of media commentary about the benefits of trusts (including Testamentary Discretionary Trusts in wills - TDTs) after the Federal budget announcements, and understandably, you may be wondering whether TDTs in your will are still worthwhile.

So, are testamentary trusts dead after the budget? (pardon the pun)

Definitely not!

They are as powerful as ever when it comes to estate planning.

TDTs still offer incredible asset protection for:
🌲family law and protecting blood line descendants,
🌲vulnerable beneficiaries,
🌲protecting minor children from financial immaturity, and
🌲people in high-risk occupations or business.

These changes are only proposed, and we know it can be difficult to make a decision when there is so much uncertainty in play.

But it’s important to remember there are many benefits of TDTs that are not impacted by the tax treatment.

On a final note, provided your will allows for the TDT to be optional, you certainly would have all your basis covered while we wait for the final word on these proposed tax changes.

Don't let a breakup undo your legacy! 🌲

5 estate planning mistakes that catch people out after separation: 💔

1️⃣Assuming separation changes your will. It doesn't. Your ex may remain a beneficiary and potentially your executor until you actively update it. Divorce revokes provisions for a former spouse—but separation alone does nothing.

2️⃣Forgetting your Power of Attorney. If your ex still holds enduring power of attorney or enduring guardian, they could make financial or medical decisions on your behalf if you're incapacitated. Revoke and reappoint.

3️⃣Leaving super out of the picture. Superannuation death benefits don't automatically follow your will—they're generally governed by legislation and directly by binding nominations. If your ex is still a legal spouse or still dependent upon you, the fund may still pay them your benefit.

4️⃣Waiting for the divorce to come through. Property settlements and divorces can drag on for months or years. If something happens to you in the meantime, your current documents control—and your ex may inherit everything.

5️⃣Ignoring guardianship for kids. Separation shifts family dynamics. If you haven't revisited who you'd want to have guardianship of your children, your outdated appointment might not reflect your current wishes.

🛑Bottom line: Update your estate planning documents as soon as you separate—don't wait for the divorce paperwork to settle as by then it may be too late. ⏰💵
